O problema central do presente trabalho é a verificação do grau de eficácia das vias política e/ou jurisdicional (e esta contenciosa ou consultiva) de aplicação das cláusulas democráticas de tratados de integração econômica regional na proteção de Direitos Humanos, entendida como prevenção ou reparação de graves violações de Direitos Humanos, aqui especificamente observados a manutenção da Democracia, em si mesma considerada um Direito Humano fundamental, e/ou os Direitos ao Devido Processo Legal, ao Contraditório e à Ampla Defesa, aqui denominados, em conjunto, de "Direito de Defesa", especialmente no âmbito dos protocolos ao Tratado Constitutivo do Mercosul e de seu acordo com a União Europeia para formação de uma zona de livre comércio, dependendo do contexto político existente na ocasião, dentro de cada organização regional considerada, favorável ou não à garantia dos referidos Direitos Humanos, independentemente de quaisquer interesses políticos ou econômicos dos Estados Membros de cada organização, estudando-se casos concretos ou potenciais de aplicação daquela cláusula democrática ocorridos no Paraguai, na Áustria, na Venezuela e no Brasil.

The central problem of the present work is the verification of the degree of effectiveness of the political and / or judicial (and this last one contentious or advisory) way of applying the democratic clauses of regional economic integration treaties in the protection of Human Rights, understood as prevention or reparation of grave violations of Human Rights, specifically observing the maintenance of Democracy, which in itself is considered a fundamental Human Right, and / or the Rights to Due Legal Process, Contradictory and Broad Defense, hereinafter collectively referred to as "Right of Defense", especially in the framework of the protocols to the Mercosur Treaty and its agreement with the European Union to establish a free trade area, depending on the political context existing at the time, within each regional organization considered, favorable or not to the guarantee of Human Rights, regardless of any political or economic interests of the Member States of each organization, by studying actual or potential cases of application of that democratic clause occurred in Paraguay, Austria, Venezuela and Brazil.
