Esta tese tem como objetivo central retomar, de modo crítico, o programa teórico que busca, através de uma filosofia imanente, compreender o movimento histórico sem cair no fatalismo determinista. Pensar, deste modo, a totalidade, suas partes e a emengencia de novas relações. Com isso, a tese tem como principal desafio/problemática, compreender, ou pelo menos, buscar novos caminhos, para se analisar a dinâmica que movimenta a história. Assim, num primeiro momento, procura-se detalhar, de modo crítico, as principais categorias que "sustentam" esse programa, a saber: a determinação, a causalidade e as formas sociais. Por isso, será necessário fazer uma abordagem temática, e não autoral, das categorias estabelecidas Ainda, iremos demonstrar empiricamente, através do materialismo histórico, especialmente de Marx, Althusser, Balibar e Mascaro, como tais conceitos podem, e devem, ser usados (como ferramenta teórica) e analisados concretamente. Por fim, ressaltar o papel das formas sociais, sua dinâmica e sua conformação dentro dessa dinâmica histórica e social, com o intuito de estabelecer a teoria e a prática na compreensão do fenômeno estrutural do capitalismo. Nesse contexto, a obra do jurista soviético Evguiéni Pachukanis adquire protagonismo, pois demonstra cmoo a forma jurídica assume papel estruturante na compreensão da sociabilidade presente.

This thesis has as its main objective to revisit, in a critical way, the theoretical program that it seeks, through an immanent philosophy without falling into deterministic fatalism. Thinking, in this way, of the totality, its parts and the emergence of new relationships. Thus, the main challenge/problem of the thesis is to understand, or at least to seek new paths, to analyze the dynamics that moves history. Thus, at first, an attempt is made to detail, in a critical way, the main categories that support this program, namely: determination, causality and social forms. Therefore, it will be necessary to take a thematic rather than an "authorial" approach to the established categories. We will also empirically demonstrate, through historical materialism, especially Marx, Althusser, Balibar and Mascaro, how such concepts can, and should, be used (as a theoretical tool) and analyzed concretely. Finally, to emphasize the role of social forms, their dynamics and their conformation within this historical and social dynamics, in order to establish theory and practice in understanding the structural phenomenon of capitalism. In this context, the work of the Soviet jurist Evguiéni Pachukanis acquires prominence, as it demonstrates how the legal form assumes a structuring role in understanding the present sociability.
