O presente estudo se concentra na análise das disposições referentes à promoção e à proteção do regime e dos ideais democráticos no Direito Internacional e a sua aplicação pelos tribunais internacionais, com ênfase nos sistemas global e latino-americano. A pesquisa se propõe a acompanhar uma perspectiva da construção do sistema jurídico-normativo internacional, em paralelo com ocorrência das ondas democratizadoras e, no caso da América Latina, dos movimentos sincrônicos da História política regional, para assim permitir a compreensão das experiências e valores sobre os quais se assentou a criação do lastro jurídico autorizador do tratamento normativo da democracia pelo Direito Internacional, bem como da sua aplicação pelos seus sujeitos legitimados, identificando, ao final, o alcance, o modo de funcionamento e a eficácia do tratamento jurídico e da tutela jurisdicional da democracia no Direito Internacional.

This study is dedicated to an analysis of the provisions referring to the promotion and the protection of democratic rule and democratic ideals in International Law, as well as its application by international tribunals, with emphasis on global and Latin American systems. The research proposes to follow a perspective on the construction of international legal and normative framework, in parallel with waves of democratization and, in Latin America's case, with the synchronism of regional political History, in order to allow for the understanding of the experiences and values upon which lies the creation of the juridical framework on democracy in International Law, as well as its application by its able subjects, identifying, therefore, the scope, the method of operation and the legal effectiveness of legal treatment and judicial protection of democracy in International Law.
