Os regimes possíveis de proteção de dados pessoais encontram dois grandes modelos no mundo moderno, o da União Europeia e o dos Estados Unidos da América. Tais sistemas de proteção de dados apresentam-se, à primeira vista, como bastante distintos, principalmente em razão da natureza do direito de privacidade em cada um desses sistemas jurídicos. Apesar da crença geral de que tais sistemas são por natureza incompatíveis, o presente trabalho objetiva justamente avaliar, em uma perspectiva jurídica, se tal alegação é correta. Adicionalmente, o trabalho busca entender em qual medida tais sistemas convergem e divergem, avaliando também o impacto passado e a capacidade futura do Direito Internacional na composição desses sistemas. O estudo baseia-se na comparação sistemática e funcional entre os dois sistemas de proteção de dados pessoais, e análise documental e doutrinária.

The possible regimes for protection of personal data find two major models in the modern world, that of the European Union and that of the United States of America. These data protection systems appear, at first glance, to be quite different, mainly due to the nature of the right to privacy in each of these legal systems. Despite the general belief that these systems are incompatible by nature, this paper aims to assess, from a legal perspective, whether this claim is correct. Additionally, the paper seeks to understand to what extent these systems converge and diverge, and to assess the past impact and future capacity of international law in the composition of these systems. The study is based on a systematic and functional comparison between the two systems of personal data protection, and documentary and doctrinal analysis.
