A tese aborda o controle preventivo de constitucionalidade pelo Legislativo, buscando analisar-lhe as características, os modos de externalização e a efetividade. No Eixo Descritivo, expõe-se a natureza jurídica de dever-função desse controle, situado na imbricação entre o Direito e a Política, além de se situar a especificidade do controle realizado no Brasil, em relação a outros ordenamentos. Também é analisada a formação histórica da doutrina da análise preventiva de constitucionalidade, com a exposição dos meios formais e informais de seu exercício. Ainda na parte descritiva, são expostas as principais diferenças entre o papel das comissões no controle preventivo de constitucionalidade de Projetos de Lei (PL) e de Propostas de Emenda à Constituição (PEC). No Eixo Analítico, são apresentados os resultados da análise qualitativa e quantitativa das 5555 proposições analisadas (todas as PEC e todos os PLs apresentados em 2015 no Congresso Nacional). Por meio da formulação de um número-índice e de sua média (IAC e IACmédio), são expostos os resultados dos testes de hipótese, que possibilitam afirmar que o controle preventivo é, no geral, parcialmente efetivo, e que há diferenças estatisticamente significativas na comparação entre a análise em cada Casa do Congresso Nacional (Câmara dos Deputados v. Senado Federal) e em cada espécie de proposição (PEC v. PL), sendo o controle mais efetivo o realizado na Câmara dos Deputados em relação às PECs, e o menos efetivo aquele que é feito na mesma Casa, em relação aos PLs. Finalmente, no Eixo Prescritivo, são apresentadas propostas de reforma do arcabouço normativo (em nível constitucional e regimental), de modo a tornar ainda mais efetivo o controle preventivo de constitucionalidade pelo Legislativo.

The thesis studies the preventive constitutional control by the Legislative, seeking to analyze its characteristics, externalization forms and effectiveness. In the Descriptive Axis, the legal nature of the duty-function of this control wich is located in the overlap between law and politics is exposed, in addition to the specificity of the control in Brazil, in relation to other systems. The historical formation of the doctrine of preventive analysis of constitutionality is also analyzed, with the exposure of the formal and informal means of its exercise. Still in the descriptive part, the main differences between the role of parliamentary committees in the preventive control of constitutionality of Bills (PL) and of Constitutional Amendments Proposals (PEC) are exposed. In the Analytical Axis, the results of the qualitative and quantitative analysis of the 5555 analyzed propositions are presented (all PECs and all PLs presented in 2015 at the National Congress). Through the formulation of an index number and its average (IAC and IACmedium), the results of the hypothesis tests are exposed, which make it possible to state that the preventive control is, in general, partially effective, and that there are statistically significant differences in the comparison between the analysis in each House of Congress (Chamber of Deputies x Federal Senate) and in each type of proposition (PEC x PL), with the most effective control being carried out in the Chamber of Deputies in relation to the PECs, and the least effective one that is done in the same House, in relation to the PLs. Finally, in the Prescriptive Axis, proposals are presented to reform the normative framework (at the constitutional and internal level), in order to make preventive control of constitutionality by the Legislative even more effective.
