Este trabalho busca analisar a relação entre mídia e democracia, especialmente considerado o cenário brasileiro. Inicia-se adentrando no desenvolvimento do direito à informação e comunicação desde a retórica, destacando que estes direitos se tornaram basilares da sociedade contemporânea. Em sequência, minucia-se o desenvolver da questão em nossos textos constitucionais, até a Constituição Federal de 1988. Analisou-se minuciosamente o Código Brasileiro de Telecomunicações, bem como a problemática da Lei de Imprensa. Ao final, discorre-se sobre a concentração da mídia no Brasil e o descompasso com a sociedade plural verificada, explicitando a questão das rádios comunitárias.

This essay intends to analyse the relationship between media and democracy, specially regarding the brazilian scenario. It begins with the analysis of de development of the right to information and communication based on rhetoric, emphasizing that these rights have become the basis of contemporary society. Subsequently, the development of the issue in our constitutional texts, until the Federal Constitution of 1988. The Brazilian Telecommunications Act, as well as the problems of the Press Law, were analyzed in detail. At the end, a discussion about the concentrarion of the media in Brazil and the disagreement with the verified plural society is presented, explaining the community radios case.
