Ao longo dos últimos anos, as discussões em torno da cidade inteligente se difundiram largamente ao redor do mundo. Seja no debate acadêmico, no ambiente corporativo ou das políticas públicas, o conceito tem se espalhado enquanto uma noção ideal para a cidade contemporânea, em que as realizações no fluxo regular da vida urbana são amplamente intermediadas pelas tecnologias digitais. No Brasil, embora múltiplas abordagens sobre a cidade venham se difundindo de maneira imprecisa e desordenada, o conceito é cada vez mais presente na vida institucional dos municípios do país, gerando insegurança sobre a sua incorporação. Considerando que a propagação da cidade inteligente é produto e consequência da revolução tecnológica contemporânea, descrita como a quarta revolução industrial e marcada pela ubiquidade das tecnologias digitais, este trabalho procura identificar os fundamentos constitucionais e jurídico-econômicos para que a incorporação da cidade inteligente pelos territórios brasileiros seja planejada e coordenada de modo que seus benefícios sejam sobrepostos aos seus potenciais riscos e eventuais prejuízos. Para isso, primeiramente buscou-se identificar o contexto histórico-econômico da cidade inteligente, que apresenta janelas de oportunidade para o desenvolvimento nacional, mas também riscos e desafios que são próprios, diante dos paradigmas econômico-políticos atuais, da ubiquidade das tecnologias digitais e da centralidade da vida urbana. Também foram identificadas as dimensões que o conceito de cidade inteligente carrega, sendo proposta uma perspectiva alinhada às diretrizes econômico-constitucionais sobre as funções sociais da cidade: a cidade inteligente orientada pela realização de suas funções sociais. Após, o conceito de cidade inteligente foi submetido às normas da constituição econômica formal brasileira, que indicam as bases para sua incorporação institucional de modo alinhado aos objetivos fundamentais da república, à realização das funções sociais da cidade e à concretização dos direitos sociais no território urbano. Por fim, são identificadas as tarefas institucionais primordiais para que a incorporação do conceito de cidade inteligente seja apropriada pelos municípios brasileiros em conformidade com os fundamentos definidos pela Constituição Econômica do país.

Over the past few years, discussions around the concept of smart city have spread widely around the world. Whether in the academic debate, in the corporate field or in public policy environment, the concept has spread as an ideal notion for the contemporary city, where achievements in the regular flow of urban life are largely intermediated by digital technologies. In Brazil, although multiple approaches of the city have been spreading imprecisely and disorderly, the concept is increasingly present in the institutional life of the countrys municipalities, generating insecurity about its incorporation. Considering that the spread of smart cities is the product and consequence of the contemporary technological revolution, described as the fourth industrial revolution and marked by the ubiquity of digital technologies, this work seeks to identify the constitutional and juridical-economic foundations so that the incorporation of the smart city by Brazilian territories is planned and coordinated in order to make its benefits overcome potential risks and eventual losses. For this, this research first sought to identify the historical-economic context of the smart city, which presents windows of opportunities for national development, but also risks and challenges that are their own, in the face of current economic-political paradigms, the ubiquity of digital technologies and the centrality of urban life. It also identified the dimensions that the concept of smart city carries, proposing a perspective that aligns with the economic-contitutional guidelines about the social functions of the city: the smart city oriented by the achievement of its social functions. Then, the concept of smart city was submitted to the norms of the formal Brazilian economic constitution, which indicate the foundations for its institutional incorporation in a way that aligns with the main goals of the Republic, the achievement of the social functions of the city and the realization of social rights in the urban territory. Finally, the primary institutional tasks are identified so that the incorporation of the concept of smart city is appropriated by Brazilian municipalities in accordance with the foundations defined by the Economic Constitution of the country.
