Este trabalho estuda o modo de produção das leis de falências e concordatas no Brasil entre os anos de 1850 e 1945. Partindo já da promulgação do Código Comercial em 1850, analisamos os debates legislativos e mensagens oficiais nos casos dos decretos do Executivo que tiveram como foco o tema das falências e das concordatas, buscando cruzar com outras fontes os diferentes pontos de vista sobre as propostas de reformas dessas leis, em especial por meio da análise das publicações em jornais dos diferentes períodos, bem como em relatórios ministeriais e mensagens presidenciais até a edição do Decreto-lei no 7.661 de 1945. O trabalho pôde identificar os pontos de vista daqueles que foram derrotados nos debates sobre as reformas das leis, bem como os fundamentos e escolhas de políticas públicas daqueles que foram os vitoriosos entre os elaboradores das leis. Além disso, por meio de um levantamento por amostragem de publicações de decisões de primeira instância, entre 1890 e 1945, conforme publicadas no Jornal do Comércio do Rio de Janeiro, em especial dos processos da comarca da capital do Brasil durante o período, pudemos explorar um conhecimento prático e verificar se aquela prática estava sincronizada com os argumentos utilizados pelos legisladores de cada um dos períodos.

This research studies the way in which bankruptcy (falências) and concordat agreements (concordatas) laws were drafted and approved as modes of production of the Brazilian legislation between the years of 1850 and 1945. Beginning from the Commercial Code in 1850, this research analyzes the legislative debates and official messages in the cases of Executive decrees that focused on the matters of bankruptcies and concordats, seeking to cross with other historical sources the different points of view on the proposals for reforms of these laws, especially through the analysis of publications in newspapers of the different periods, as well as in ministerial reports and presidential messages until the edition of Decree-law n. 7,661 of 1945. This research was able to identify the points of view of those who were defeated in the debates on reforms of the laws, as well as the foundations and choices of public policies of those who were the victorious among the lawmakers. In addition, through a sample survey of publications of first instance decisions, between 1890 and 1945, as published in the Jornal do Comércio do Rio de Janeiro, in particular processes of the district of the capital of Brazil during the period, this research was able to explore a practical knowledge of the practice of bankruptcy law and verify if that practice was synchronized with the arguments used by the legislators of each one of the periods.
