O presente trabalho estuda a evolução da responsabilidade civil por danos de cartel, prática que é costumeiramente apontada como a mais grave infração concorrencial. O estudo elaborado neste trabalho partirá dos conceitos básicos afeitos à matéria (tanto sob a ótica da disciplina de cartel, quanto da responsabilidade civil) para identificar como esse ramo específico da reparação de danos se desenvolveu no Brasil e no mundo, desde os primórdios do tratamento do tema nos Estados Unidos da América até as recentes inovações normativas na Europa e, agora, no Brasil, para fortalecimento do direito indenizatório daqueles que se veem prejudicados por esse ilícito de altíssimo potencial danoso. Será apresentada, ao longo do trabalho, análise crítica das alterações e propostas de alteração do sistema de reparação de danos de cartel brasileiro, bastante pautada no estudo da experiência internacional, com o objetivo de contribuir para que o sistema brasileiro de private enforcement se torne efetivamente capaz de conferir aos lesados perspectiva real de reparação dos danos observados.

This dissertation analyses the evolution of the civil liability for cartel damages, practice which is commonly pointed out as the most relevant? antitrust violation. The study elaborated in this dissertation will begin with basic concepts linked to the matter (both from the optics of the cartel discipline as from civil liabilitys) in order to identify how did this specific framework of civil liability had evolved in Brazil and around the world, since the beginning of the treatment of the matter in United States to the recent normative innovations in Europe and, more recently, in Brazil in order to strengthen the right of claiming damages of those harmed by this infringement with a high damages ceiling. It will be presented, towards this dissertation, critical analysis of the alterations and propositions of alteration for the Brazilian private enforcement, highly based on the study of international experience, aiming to contribute in order to turn the Brazilian private enforcement system into a system capable of giving a real perspective of damages compensation for those who were harmed.
