Com o advento da Lei n. 13.467/17 em 11/11/17 (Reforma Trabalhista), indagou-se se houve retrocesso nos direitos outrora conquistados e se a nova legislação impactou e, ou, irá impactar o meio ambiente de trabalho e a saúde humana. Pretendeu-se, neste estudo, estabelecer o diálogo entre o Direito do Trabalho, o Direito Ambiental e o Direito Ambiental do Trabalho, com vistas ao meio ambiente de trabalho equilibrado e à saúde humana. Foi realizada pesquisa bibliográfica e documental para obtenção de dados sobre a qualidade do ambiente laboral junto a Órgãos Públicos. Além da busca bibliográfica e documental, foram realizadas também entrevistas com alguns dos principais atores sociais envolvidos; elegeram- se, para tanto, os agentes do Estado, que, a princípio, são neutros, pois não representam nem empregadores e nem empregados; são os fiscais do Centro de Referência em Saúde do Trabalhador CEREST e os Auditores Fiscais do Trabalho do Ministério do Trabalho e Emprego, uma vez que estes fiscais possuem experiência empírica e uma visão ampla da problemática em estudo. Buscou-se a definição dos fatores limitantes e desafios para o equacionamento da problemática. Os resultados indicam que a reforma trabalhista (Lei n. 13.467/17) alterou as relações travadas entre empregados e empregadores, em especial quanto à nova possibilidade de terceirização irrestrita e ainda quanto ao enfraquecimento das entidades sindicais (antes protagonistas na fiscalização do ambiente laboral) causando efeitos negativos práticos (e reais) sobre o ambiente laboral.

The introduction of Law n. 13,467/17 on 11/11/17, known as the Labor Reform, raised concerns about potential setbacks in acquired rights and the impact it may have had or will have on the work environment and human well-being. This study aims to foster a dialogue among Labor Law, Environmental Law, and Environmental Labor Law. Bibliographical and documentary research was conducted to gather data on the quality of the work environment within Public Bodies. In addition to the literature review and data analysis, interviews were conducted with key stakeholders. The interviewees were carefully selected, focusing on State agents who maintain a neutral standpoint, devoid of allegiance to employers or employees. These selected agents include inspectors from the Reference Center for Worker's Health CEREST and Labor Inspector Auditors from the Ministry of Labor and Employment. Their invaluable empirical experience and comprehensive perspectives contribute to understanding of the issue at hand. By doing so, our objective was to identify the underlying constraints and confront the challenges associated with resolving this problem. The findings reveal that the labor reform (Law n. 13.467/17) has altered the dynamics between employees and employers, particularly concerning the expanded scope of outsourcing and the diminished influence of labor unions, previously pivotal in overseeing the work environment. Consequently, practical and tangible negative effects have manifested within the working environment.
