A partir da Segunda Guerra Mundial, a democracia e os direitos humanos tornaram-se a ordem jurídico-política da parte ocidental do globo. Apesar de a democracia se apresentar como o modelo de governo no qual melhor se preservam e se manifestam os direitos humanos, levantes antidemocráticos tornam-se ordinários, mesmo em países cujas democracias eram julgadas como consolidadas. Diante desse cenário que se mostra mais comum a partir dos anos 2010, o presente estudo busca analisar possíveis hipóteses políticas e jurídicas de crise democrática no contexto de Brasil e Argentina, restringindo o estudo quanto a análise de aspectos de direito constitucional e internacional. Por meio da metodologia comparativa entre os países objetos de pesquisa, revisão bibliográfica, documental, legislativa e de veículo de imprensa; os três capítulos dessa dissertação procuram demonstrar as incongruências existentes no sistema constitucional de Brasil e Argentina e do sistema internacional por meio das organizações internacionais que os mencionados países estão inseridos, pela forçosa convivência de aspectos conservadores e progressistas.

From the Second World War, democracy and human rights became the juridical-political order of the western part of the globe. Although democracy presents itself as the model of government in which human rights are best preserved and manifested, anti-democratic uprisings become commonplace, even in countries whose democracies were judged to be consolidated. Faced with this scenario, which has become more common since the 2010s, this study seeks to analyze possible political and legal hypotheses of a democratic crisis in the context of Brazil and Argentina, restricting the study to the analysis of aspects of constitutional and international law. Through the comparative methodology between the research object countries, bibliographical, documentary, legislative and press vehicle review; the three chapters of this dissertation seek to demonstrate the existing inconsistencies in the constitutional system of Brazil and Argentina and in the international system through the international organizations that the mentioned countries are inserted, due to the forced coexistence of conservative and progressive aspects.
