Os debates sobre a construção democrática são marcados, nas décadas finais do século XX, pelo surgimento de novas experiências de participação da sociedade em políticas públicas. Este trabalho analisa fatores que contribuem para o maior alcance democrático destas experiências, na perspectiva da construção de novas políticas de direitos. Analisa também a construção de novos paradigmas de direitos - o paradigma da proteção integral aos direitos da infância e os paradigmas do direito à moradia e à cidade - e os elementos que eles trazem para o debate sobre a construção de um novo Estado social na América Latina. Foram estudadas novas formas de participação da sociedade civil nas políticas de moradia e de infância, nos cinco países do cone sul, Argentina, Brasil, Chile, Uruguai e Paraguai. O estudo fundamentou-se em entrevistas realizadas com representantes de organizações sociais e em visitas de campo a experiências participativas nos cinco países, bem como em pesquisa bibliográfica sobre as referidas políticas sociais e sobre a participação da sociedade nas mesmas. A análise das informações coletadas aponta para dois fatores que afetam especialmente a qualidade democrática da participação nas políticas estudadas. Em primeiro lugar se destaca a importância do perfil da sociedade civil, incluindo sua composição e capacidade de iniciativa. A composição da sociedade civil que revela maior incidência na construção de políticas de direitos inclui e articula atores locais, atores profissionais e atores marcados pela participação em lutas por direitos. A capacidade de iniciativa na elaboração de )propostas para as políticas públicas depende do aporte de atores profissionais e das experiências de participação da sociedade em programas sociais. O estudo destaca também a relevância do desenho institucional das políticas, especialmente dos processos de descentralização e construção de sistemas articulados de políticas sociais. Uma articulação vertical, com responsabilidades definidas para os âmbitos nacionais e subnacionais, e horizontal, que integre diferentes programas sob diretrizes públicas gerais pode conferir maior potencial aos espaços participativos locais. Sem esta articulação a participação limita-se ao âmbito local e tem menor incidência sobre espaços decisórios das políticas. A sociedade que participa na construção dos novos paradigmas de direitos nas áreas da infância e da moradia envolve-se com os temas centrais do debate atual sobre concepções de direitos e de políticas sociais, sobre o papel do Estado na garantia dos direitos e o papel da sociedade no controle social sobre as políticas. O trabalho aponta que estes novos sistemas de políticas públicas aportam elementos importantes para estes debates e para a construção de um projeto democrático de reforma do Estado, ou de um novo Estado social

In the last decades of the 20th century, the debates about the democratic building are marked by the emergence of new experiences of the society's participation in the public policies. This thesis analyzes some factors that help increase the democratic extent of these experiences in the building of new policies of rights. It also analyzes the building of new paradigms of rights the paradigm of total protection of the children rights and the paradigm of the right to housing and the right to the city - and the elements brought by them to the debate cabout the building of a new Social State in Latin America. New forms of civil society participation in the policies for children and housing in the 5 counties of South Cone of Latin America - Argentina, Brazil, Chile, Uruguay and Paraguay - were studied. The study was based on interviews made with representatives of social organizations and in field visits to participative experiences in these 5 countries, as well as in bibliographic review on the referred social policies and about the participation of the society in these policies. The analysis of collected information points toward two factors which especially affect democratic quality of participation of the studied policies. The first highlighted factor is the importance of the civil society profile, including its composition and initiative capacity. The composition of the civil society with the biggest influence capacity in the building of policies of rights includes and articulates local stakeholders, professional stakeholders and actors marked by their participation in struggles for rights. The iniciative capacity in working up projects in public policies depends on the presence of professional stakeholders and on the experiences of participation of society in social programs. The study also highlights the relevance of the policy institutional framework, especially of decentralization and building of social policies articulated systems. A vertical articulation with defined responsibilities for the national and sub-nationallevels, and horizontal, which integrates different programs under general public directives, may give bigger potential to the local participative spaces. Without this linkage, the participation is limited to the local reality and has less influence on decision-making processes. The participation of the society in the building of new paradigms of rights in the areas of children and housing is related with the central subjects of current debates about conceptions of rights and of the social policies, on the role of the state in assuring rights and the role of society in the social control of the policies. This work points out that these new public policy's systems bring important elements to these debates and for the building of a new democratic project of the State reform, or of a new social State
