Os Estados Partes do Mercosul firmaram acordos e criaram os respectivos mecanismos parapromoverem a livre circulação de pessoas, bens, capital e trabalho na sua região. E criarammecanismos legais em favor da cooperação jurídica entre as autoridades centrais para a realizaçãode atos judiciais e extrajudiciais em geral necessários para resolver conflitos originados das relaçõespessoais e empresariais unidas por dois ou mais países. Aplicado o direito comparado na análise doreferencial teórico, constatou-se a mesma natureza intergovernamental nesse tipo de cooperaçãonaquele bloco e na União Europeia, distinguindo-se aquele pela intermediação das autoridadescentrais, e esta porque se faz diretamente entre as autoridades nacionais. Um dos problemasevidenciados nas pesquisas de campo, é a demora na remessa e retorno das cartas rogatórias eauxílio direto no Mercosul, em sua maioria transitando em meio físico (papel ou mídia),dependendo de serviços de terceiros para sua coleta, incorrendo em riscos de interceptação eextravio, o que se reflete no acesso à justiça. A partir do diálogo das fontes, foi possível confirmarque as legislações processuais contemplam o uso dos documentos eletrônicos em processosjudiciais e extrajudiciais, independentemente de acordo para seu reconhecimento entre os EstadosPartes, portanto os ordenamentos jurídicos nacionais e os protocolos de cooperação jurídica nobloco bastam para tramitar os pedidos. A proposta principal da tese é a solução dos problemasapontados com um método de fluxo de trabalho por meio da plataforma digital LUNA, contruídosespecialmente para as autoridades centrais operarem em conjunto, excluir-se aqueles intermediários.Os resultados dos testes demonstraram que a plataforma digital LUNA pode integrar todas asautoridades envolvidas no cumprimento dos pedidos, atender os quesitos de presteza no envio dospedidos de cooperação jurídica entre os Estados Partes, além de dar publicidade dos atos nosprocessos e oportunizar o diálogo entre as autoridades judiciárias em prol do favorecimento daformação de uma cultura jurídica para o Mercosul.

Mercosul States Parties signed agreements and created the respective mechanisms to promote thefree movement of people, goods, capital and labor in their region. They have created legalmechanisms in favor of legal cooperation among the central authorities to carry out judicial andextrajudicial acts in general necessary to resolve conflicts arising from personal and businessrelations united by two or more countries. Applied the comparative law in the analysis of thetheoretical background, the same intergovernmental nature was verified in this type of cooperationin that bloc and in the European Union, distinguishing the former through the intermediation of thecentral authorities, and the latter because it is done directly among the national authorities. One ofthe problems highlighted in field researches is the delay in sending and returning international letters rogatory as well as the direct assistance in the Mercosul, most of which transit throughphysical means (paper or media), depending on third parties services for their collection, incurringrisks of interception and loss, which reflects in the access to justice. From the dialogue of sources, itwas possible to confirm that the procedural laws observe the use of electronic documents in judicialand extrajudicial proceedings, regardless of agreement for their recognition among the StatesParties. Therefore, the national legal systems and the legal cooperation protocols in the bloc areenough to process the requests. The main proposal of the thesis is the solution of the problemspointed out with a workflow method through the LUNA digital platform, constructed especially forthe central authorities to operate in jointly, excluding those intermediaries. The results of the testsdemonstrated that the LUNA digital platform can integrate all the authorities involved in thefulfillment of requests, meet the requirements of promptness in sending requests for legalcooperation among the States Parties, in addition to providing publicity of the acts in the processesand provide an opportunity for dialogue among the judicial authorities in favor of the formation of alegal culture for Mercosul.
