Abstract in English
Master's research in which the problem of female imprisonment is addressed. A male look at the appalling conditions of female incarceration in Brazil and São Paulo. It seeks to identify the principles and norms of human rights and find out if they exist, and how they exist, implemented and liable to be described and analyzed, even if only in a fraction of the female prison life of Metropolis of São Paulo. It is imperative to promote the debate on public policies to promote the fundamental human rights and constitutional guarantees of the imprisonment of women. The state's penal and prison policy is inadequate and disregards the social and cultural factors that permeate the use of trade and the illicit "war on drugs" in Brazil, especially with regard to women. Non-bailable crime, lengthy process and serving the selective and stigmatizing sentence. Ignoring gender situations and the peculiarities of women's crimes, the penalty is inadequate and cruel. The aggressive approach to female offenses shows intolerance and conflict. A study on humanities, rights and other legitimacy, involved in the Joint Sciences of Criminal Law, leads us to believe that the sanction imposed on most women is an irrational form of social control that reproduces violence instead of preventing it. In short, paraphrased Pierre Bourdier: "I will present here research in which I am busy. They will be presented in the initial state, that is to say, in a confused, embryonic state, research that, usually, would be finished" or not.
