O presente trabalho analisa a descriminalização do aborto sob a perspectiva da Criminologia Feminista com a abordagem do cenário jurisprudencial e legal acerca do tratamento jurídico penal do aborto. Tema da ordem do dia, com a realização de debates e discussões legais e jurisprudenciais acerca de sua descriminalização, e a propositura de iniciativas de lei tanto para a legalização quanto para a criminalização, o aborto revela-se tema intrigante e que propõe a revisão da influência das questões de gênero no Direito Penal. Analisa-se sob a perspectiva da criminologia feminista a pertinência da atual criminalização por um sistema jurídico-penal historicamente voltado a criminalidade masculina, pensado por e, principalmente, para homens, de uma conduta praticada por mulheres e que se refere aos corpos femininos. O aborto é conceituado e analisado sob a perspectiva legal brasileira e no cotejo com os direitos fundamentais envolvidos. O cenário jurisprudencial é analisado sobretudo com foco nos recentes julgados do Supremo Tribunal Federal acerca do aborto e o cenário legislativo, mediante a abordagem de projetos de lei voltados a descriminalização e ao incremento da proibição do aborto. Este trabalho ainda realiza um estudo dos casos julgados pelo Supremo Tribunal Federal que envolveram o crime de aborto, bem como expõe o embate com o tratamento político criminal acerca da criminalidade feminina.

This paper analyzes the decriminalization of abortion from the perspective of feminist criminology with the approach of the jurisprudential and legal scenario about the criminal legal treatment of abortion. An agenda item, with debates and legal and jurisprudential discussions about its decriminalization, and the proposition of legal initiatives for both legalization and criminalization, abortion is an intriguing theme that proposes the revision of the law. influence of gender issues in criminal law. It is analyzed from the perspective of feminist criminology the relevance of the current criminalization by a criminal-legal system historically focused on male crime, thought by and, mainly, for men, of a behavior practiced by women and that refers to the female bodies. Abortion is conceptualized and analyzed from the Brazilian legal perspective and in comparison with the fundamental rights involved. The jurisprudential scenario is analyzed mainly focusing on the recent Brazilian Supreme Court judgments on abortion and the legislative scenario, by addressing bills aimed at decriminalization and increasing the prohibition of abortion. This work also conducts a study of the cases judged by the Brazilian Supreme Court that involved the abortion crime, as well as exposes the clash with the criminal political treatment about the female crime.
