A punição é uma temática que esteve presente por toda a história da humanidade. Sempre houve exemplos de castigos para atos que uma sociedade considerava inapropriados. Essa característica social não ficou alheia à literatura. Ela é retratada, com especial rigor, por Dante Alighieri, na Comédia. Nesta obra, que resumidamente é a "arte de julgar os outros", observamos a presença de toda uma semântica jurídica ligada à punição. Assim, é objetivo deste trabalho dar enfoque às questões ligadas ao julgamento dos outros - em especial com vistas ao castigo. Para isso, num primeiro momento destacamos todo o campo semântico ligado à questão do julgamento, do direito, da justiça e da moral no contexto da Baixa Idade Média. Depois, trazemos o fundamento filosófico dessas mesmas questões, ou seja: do campo do julgamento, do direito, da justiça e da moral nesse período. E, por fim, exploraremos a justificativa para a punição, qual seja, o livre-arbítrio, para então entender como na prática uma punição poderia ocorrer. A pena a qual será mais dado destaque é a pena de infâmia, devido a sua importância na vida pessoal do poeta, bem como a sua constante presença na obra que se está analisando. O trabalho se justifica pela constante presença da temática punitiva nas obras literárias. O método empregado é o dedutivo, pois procura-se fazer uma afirmação geral e resgatar aspectos individuais a seguir.

Punishment is a theme that has been present throughout human history. There have always been examples of punishments for acts that a society used to consider inappropriate. This social characteristic did not stay remote to literature. It is shown, with great accuracy, by Dante Alighieri in the Divine Comedy. In this work, which briefly is "the art of judging others" we can notice the presence of a legal semantics connected to punishment. Therefore, it is the purpose of this thesis to focus on issues related to judgement of others - especially when aiming punishment. For this purpose, at first we highlight the semantic range connected to questions of judgment, rights and the moral in the context of the Low Middle Age. Then, we bring the philosophical foundation of these same issues, meaning: the fields of judgment, rights, justice and moral at that time. Lastly, we will explore the justification for punishment, whatever it was, the free will, to then understand how in practice a punishment could happen. The penalty which will be given more prominence is the penalty of infamy, due to its importance in the poet's personal life, as well as its constant presence in the work being analyzed. The work is justified by the constant presence of the punitive theme in the literary works. The method used is the deductive, because it seeks to make a general statement and rescue individual aspects to follow.
