Esta tese tem por objetivos: (i) apresentar uma edição semidiplomática justalinear de três processos criminais ocorridos na cidade de Campinas nos anos de 1845, 1853 e 1858; (ii) apresentar uma proposta de mapeamento das estruturas de impessoalidade presentes nos processos; apresentar como as estruturas de impessoalidade e outras evidências linguísticas encontradas caracterizam ou não a imparcialidade da justiça perante réus escravizados. A leitura e edição dos documentos manuscritos foram balizadas nos conhecimentos das áreas de Filologia e Linguística Histórica. A análise pautou-se no modelo das Tradições Discursivas, com base em Koch; Oesterreicher (1990) e Kabatek (2006). A análise também levou em consideração aspectos linguísticos-discursivos propostos por Simões; Kewitz (2006, 2009) para os corpora do português brasileiro. Ao todo os três processos e suas respectivas sentenças são compostos por 210 fólios recto e verso que tratam de escravizados acusados e julgados por homicídio e levados à forca, sendo rica fonte de dados históricos, socioeconômicos e, sobretudo, linguísticos graças à variedade de enunciados e punhos que compõem esses processos. Esses processos forneceram importantes dados que ajudaram a mapear características importantes e marcantes de textos da esfera jurídica brasileira no século XIX

This thesis aims to: (i) present a semi-diplomatic edition of three criminal proceedings that took place in the city of Campinas in the years of 1845, 1853, and 1858; (ii) map the structures of impersonality present in these proceedings; and (iii) examine how the structures of impersonality and other linguistic evidence characterize or do not characterize the impartiality of justice toward enslaved defendants. The reading and editing of the handwritten documents were guided by the knowledge in the areas of Philology and Historical Linguistics. The analysis was based on the model of Discursive Traditions, following Koch; Oesterreicher (1990) and Kabatek (2006). The analysis also took into consideration linguistic-discursive aspects proposed by Simões; Kewitz (2006, 2009) for Brazilian Portuguese corpora. In total, the three proceedings and their respective sentences consist of 210 recto and verso folios dealing with enslaved individuals accused and judged for homicide and subsequently executed, providing a rich source of historical, socioeconomic, and, above all, linguistic data due to the variety of voices and hands that compose these proceedings. These proceedings provided important data that helped map significant and distinctive characteristics of texts in the Brazilian legal sphere in the 19th century
