Este trabalho de pesquisa versa sobre o processo de formulação da política educacional brasileira, entre 1979 e 1995, antecedendo a Lei de Diretrizes e Bases da Educação Nacional de 1996, em que se destaca a participação de dois agentes sociais com interesses distintos e antagônicos: os Trabalhadores da Educação e os Empresários da Educação. Foram estabelecidos como objetivos do trabalho identificar o conflito inerente ao processo político, bem como a política de educação resultante. A investigação revelou o caráter pedagógico da luta política empreendida e um desfecho inesperado para a discussão: a política da educação foi decidida fora do campo da educação nacional, à revelia dos atores envolvidos, na conjuntura de hegemonia do mercado, em que se forjava uma outra institucionalidade

The present research work is about the process of formulating the Brasilian educational policy from 1979 to 1995, prior to the law number 9.394 of December 20`h., 1996, which establishes the directions and basis of education. The aforementioned work highlights the performances of two social agents with distinct and antagonistic interests: Education Workers and Education Entrepreneurs. The aims of this work are to identify both the conflict inherent to the political process and the resulting educational policy. The investigation conducted revealed the pedagogical nature of the political conflict and the unexpected outcome for the discussion: the educational policy has been determined outside the national education field, without the participation of the players involved in the context of market hegemony, in which another institutionalization was being forged
