Esta tese tem por objeto os sentidos das políticas de emigração adotadas em Portugal ao longo da Monarquia Constitucional. O período estudado inicia-se em 1835, quando uma emigração de tipo novo indignou os agentes públicos e os impeliu a agir para atenuar os efeitos nefastos de um fluxo que irrompeu de forma surpreendente. A pesquisa se encerra nos primeiros anos do regime republicano (instaurado em 1910), no dealbar da Grande Guerra que encerrou o último ciclo da emigração para o Brasil iniciado na Monarquia. São dois os principais objetivos da pesquisa: (i) observar os aspectos da(s) realidade(s) emigratória(s) disponível(eis) aos agentes estatais encarregados de elaborar os textos normativos e (ii) avaliar se as políticas emigratórias adotadas contrariavam os ditames do liberalismo oitocentista e se ultrapassavam os limites da Carta de 1826 (que vigorou ao longo da maior parte do regime). Para atingi-los, foi analisado um corpus documental composto: pelas leis relativas à emigração portuguesa e à imigração brasileira (e seus respectivos projetos, bem como decretos, portarias e circulares); por ofícios, relatos e representações enviados aos principais ministérios portugueses envolvidos como o assunto (como os Ministérios do Reino e dos Negócios Estrangeiros) por cônsules no Brasil, autoridades provinciais e locais; além de debates e inquéritos parlamentares. Cada novo diploma proposto ou aprovado foi entendido como um evento motivado pela complexa relação entre fatores conjunturais e estruturais e como o resultado de uma prática social específica: a de legislar. A análise dos conflitos que permearam cada um desses eventos evidencia os limites de uma compreensão monolítica do Estado, a qual o entende como um sujeito todo poderoso, permeável aos interesses de uma determinada classe social. Devido à natureza das fontes levantadas e do fenômeno examinado, esta tese adotou uma perspectiva transnacional.

This dissertation has by object the meanings and directions of migration policies approved over the Portuguese Constitutional Monarchy. The studied period begins in 1835, when a new and shocking emigration flow, with peculiar characteristics, outraged Portuguese political agents and impelled them to mitigate its nefarious effects. The research concludes at the beginning of the Portuguese Republic when the outbreak of the First World War put an end to the last Monarchy emigration cycle to Brazil. This work has two main goals: (i) to observe the aspects of the Portuguese emigration realities which were available to political agents responsible for preparing the normative texts on the issue and (ii) to evaluate whether the adopted emigration policies contradicted the liberalism propositions and if those policies went beyond the limits imposed by the 1826 Constitution (which survived through most of the studied period). To those goals to be achieved, it was analyzed a documental corpus consisted of: the laws on Portuguese emigration and Brazilian immigration (and its respective drafts, and amendments, decrees, resolutions, and other measures); memorandums, reports and petitions, all sent by consuls in Brazil or district and local authorities to the ministers related to the matter (such as the minister of the Realm and the minister of Foreign Affairs); as well as parliamentary debates and inquiries. This study understood the bills as the result of a complex interaction between conjuncture and structural factors and the consequence of social practice: the legislating one. The work analyzes the conflicts that pervaded the approval (or not) of each of them and demonstrates the limits of a monolithic comprehension of the State, which sees it as a powerful subject available to pursuit classist's interests. The thesis adopted a transnational approach due to the kind of analyzes sources and because of the emigration's nature.
