Este estudo analisa a prática jurídica no vice-reinado do Peru pelos processos conservados na Real Audiência de Lima no anos de 1728 a 1800, tendo como eixo condutor os casos julgados de violência feminina. Dentre os variados crimens envolvendo as mulheres selecionamos os crimes contra a pessoa, como assassinato, estupro, rapto, agressões e injúrias. Processualmente, tais crimes trouxeram discussões probatórias e teológicas interessantes, evidenciando uma resposta judicial diferente ao considerar o gênero, a etnia e o lugar social dos litigantes. Esta pesquisa também analisou como a sociedade limenha utilizava o sistema judiciário como meio de resolução de seus conflitos, compreendendo quais eram e como foram julgados pelos tribunais e demais instâncias jurisdicionais. Dessa forma, a prática jurídica se revelou plural, complexa e nada previsível. Para atingir este intento, recorreu-se a um conjunto documental consitutído por processos criminais consultados no arquivo histórico peruano -Archivo General de la Nación, seção causas criminais Real Audiência de Lima, em Lima - Peru, em manuais de teologia e de criminologia escritos durante o séculos XVII e XVIII, livros, artigos publicados em periódicos científicos e teses inaugurais de história e justiça. O recorte temporal se justifica por configurar uma transição entre o direito casuístico e a sua sistematização no avançar do século XIX.

This study analyzes the legal practice in the Viceroyalty of Peru through the files kept in the Royal Court of Lima from 1728 to 1800, with the cases of female violence as the main axis. Among the various crimes involving women, we selected the crimes against the person, such as murder, rape, kidnapping, assaults and insults. Procedurally, such crimes brought interesting evidentiary and theological discussions, evidencing a different judicial response by considering the gender, ethnicity, and social place of the litigants. This research also analyzed how Limeño society used the judicial system as a means of resolving their conflicts, understanding what they were and how they were judged by the courts and other jurisdictional instances. In this way, legal practice was revealed to be plural, complex, and not at all predictable. To achieve this goal, we resorted to a set of documents consisting of criminal cases consulted in the Peruvian historical archive -Archivo General de la Nación, criminal cases section - Royal Court of Lima, in Lima - Peru, in theology and criminology manuals written during the 17th and 18th centuries, books, articles published in scientific periodicals, and inaugural theses on history and justice. The temporal cut is justified because it configures a transition between the casuistic law and its systematization in the advancement of the nineteenth century.
