A presente tese é resultado da investigação sobre a relação entre capital e trabalho, inserida no sistema socioeconômico capitalista, no segmento econômico da Educação, especificamente a relação entre os proprietários das Escolas Particulares de Educação Básica Regular e os professores contratados como assalariados, na região do ABC Paulista (Estado de São Paulo, Brasil) entre 1986 e 2016. Foram pesquisadas as leis que orientaram a educação e abriram espaço para a exploração desse serviço pelo capital. Apresentou-se a adição de escolas públicas e privadas na proporção da expansão econômica do ABC Paulista. Buscou-se a forma como as escolas foram instituídas como empresas, como legalmente se formalizaram os contratos de trabalho dos professores, assim como se processavam as relações coletivas, através dos sindicatos. Examinou-se as Convenções Coletivas de Trabalho, acordos assinados entre os sindicatos dos donos do capital e dos professores, que constituíram normas juridicamente aceitas, embora temporárias, na relação trabalhista desse segmento econômico. Esmiuçou-se os processos trabalhistas impetrados pelo sindicato dos professores, coletivos e individuais, a fim de se perceber como o capital tentou ludibriar as leis trabalhistas brasileiras e as Convenções Coletivas de Trabalho com a finalidade de evitar distribuir em salários e benefícios a riqueza criada pelos professores, acumulando-a. Por fim, procurou-se entender como funcionou a principal forma de ganho do capital sobre a força de trabalho do professor, a produtividade, que por sua vez é a base da mais-valia

The present thesis is the result of the research on the relationship between capital and word, inserted in the capitalist socioeconomic system, in the economic segment of Education, specifically the relationship between the Private Regular Basic Educations owners and teachers hired as salaried workers, in the ABC Paulista region, (São Paulo State, Brazil) between 1986 and 2016. The laws that guided education and opened space for the exploration of this service by capital were research. The addition of public and private schools was presented in proportion to the economic ABC Paulista expansion. The way in which schools were established as companies was sought, how teachers employment contracts were legally formalized, as well as how collective relations were processed through syndicates. Collective Labor Conventions were examined, agreements signed between the capital syndicates of capital owners and teachers, which constituted legally accepted norms, although temporary, in the labor relationship of this economic segment. The labor lawsuits filed by the teachers syndicate, both collective and individual, were analyzed in order to understand how capital tried to deceive Brazilian labor laws and Collective Labor Conventions in order to avoid distributing the wealth created by workers in wages and benefits teachers, accumulating it. Finally, sought understand how the main form capital gain on the teachers workforce, productivity, which in turn is the basis of surplus value
