A sobreposição de políticas públicas na várzea do Tietê a leste da cidade de São Paulo, onde se encontram os últimos remanescentes meândricos desse rio na capital, implica uma situação da falta de articulação intersetorial e multinível que resulta em práticas espaciais incompatíveis entre si. Por um lado, isso se deve, à própria organização do Estado federativo, que concedeu autonomia aos governos subnacionais, mas não criou instrumentos de incentivo à cooperação. Por outro, reflete a estruturação espacial da metrópole, onde os sistemas técnicos e normativos foram arranjados a partir de uma lógica corporativa de urbanização, com prioridade à economia urbana em detrimento de demandas ambientais e sociais. A investigação partiu da pesquisa sobre a evolução dos loteamentos, das instituições e normas de regulação de ordenamento do solo e dos planos urbanísticos que envolveram essa parcela da cidade, no distrito Jardim Helena. Observa-se que, desde os primeiros projetos de retificação do rio Tietê, a várzea a leste da barragem da Penha é indicada como reservatório de retenção de águas de maneira a evitar inundações a jusante. À medida que se consolida a ocupação urbana desse setor, formulam-se políticas públicas de preservação ambiental cuja principal alegação é o comprometimento do sistema de macrodrenagem. A acumulação das políticas públicas ao longo dos períodos da urbanização da metrópole determinou a sobreposição de medidas de diferentes setores e níveis de governo, orientadas por lógicas e estratégias distintas. A tese sugere que, para compreender a sobreposição das políticas públicas no território, é fundamental o norteamento que nos proporciona a teoria da escala geográfica como artifício analítico de apreensão da realidade e como recurso para a ação, quando a cada escala corresponde um nível de intencionalidade.

The overlapping of public policies in the São Paulo Tietê River east floodplain, where the last meanders of the river are located, triggers a situation of lack of intersectoral and multilevel articulation that results in spatial practices incompatible with each other. This condition results, on one hand, from the very organization of the federative State that granted autonomy to the subnational governments but did not create instruments that encourage cooperation. On the other hand, it reflects the spatial structuring of the metropolis in which technical and normative systems were arranged based on a corporate logic of urbanization, in which the urban economy was prioritized to the detriment of environmental and social demands.This research was based upon the investigation of the land allotments evolution, the institutions, land use regulations and urban planning guidelines that involved this part of the city, on the Jardim Helena district. It is observed that since the first Tietê river rectification projects, the floodplain on east of the Penha dam is considered a water detention reservoir in order to avoid downstream flooding. With the consolidation of the urban occupation of this area, environmental preservation public policies are formulated with the main claim of committing with the macrodrainage system. The accumulation of public policies throughout the periods of metropolis urbanization led to the overlapping of government measures from different sectors and levels, guided by different logics and strategies. This thesis suggests that, in order to understand the overlapping of public policies in the territory, it is fundamental the guiding of the geographic scale theory that provides with a reality analytical device of apprehension and a resource for action, in which each scale corresponds to an intentionality level.
