Este estudo analisa as formas políticas pelas quais a atenção destinada a crianças e adolescentes foi problematizada no momento de redemocratização do país. Nesta história, constitui o evento mais significativo a legislação sancionada em 1990, o Estatuto da Criança e do Adolescente (ECA). Esta lei indica a possibilidade de um novo juízo público sobre a infância e juventude e reflete a intensa movimentação política que a antecedeu. Com o ECA, os atores envolvidos com as questões infanto-juvenis se diversificaram e passaram a assumi-lo como sua principal referência. No entanto, diante da institucionalização das violações de direitos, a forma jurídica é, sobretudo, generalizada sem um correspondente juízo público sobre a justiça. Abstract in English
This study analyzes the political way by means of wich the attention given to children and adolescents was discussed during the redemocratization of this country. The most meaningful step concerning this was the law sanctioned in 1990, the Child and Adolescent Statute (Estatuto da Criança e do Adolescente - ECA). This law indicates the possibility of a new public judgement about infancy and youth and reflects the intense political movement wich preceded it. With the ECA, the subjects involved with both infantile and juvenile issues diversified and began to see it as their major reference. Due to the institutionalization of rights violation, however, the juridical form is often generalized without a corresponding public judgement about justice. This study intends to understand the present political consequences of this phenomenon
