A pesquisa tem como objeto central as políticas criminais colocadas em curso pelos governos de Fernando Henrique Cardoso (1995-2002) e Luiz Inácio Lula da Silva (2003-2010) e os discursos governamentais mobilizados em torno das medidas adotadas. A partir disso, procura-se examinar o papel que a noção aberta e imprecisa de "Crime Organizado" cumpriu na elaboração de tais políticas. Por meio de uma investigação qualitativa em documentos, cujos resultados foram estudados à luz de metodologias de análise de discurso e de análise de política criminal, explora-se a hipótese de que o paradigma de "guerra ao Crime Organizado" emergiu no Brasil após o período de redemocratização e, por meio da hibridização com distintas racionalidades, foi mobilizado - ainda que de distintas formas - como uma justificativa relevante, nos dois governos estudados, para a adoção de medidas de incremento do controle social, da vigilância, da militarização da segurança e da repressão no país. Propondo um diálogo cruzado entre as concepções foucaultianas e marxistas dos estudos sociológicos sobre os mecanismos de punição e sobre o neoliberalismo e analisando, também, a construção global e estadunidense da questão do "Crime Organizado" como um problema de governo, a pesquisa busca contribuir com os debates sobre a ocorrência de uma espécie de "guinada punitiva" em diferentes contextos do mundo com o advento do neoliberalismo como racionalidade política preponderante. Atento a possíveis rupturas e continuidades, o trabalho mapeia os movimentos em torno da questão e investiga como os câmbios verificados no Brasil inserem-se em processos globais mais amplos, destacando os engates e reforços destes processos com particularidades sociais do caso brasileiro.

The central object of this dissertation is the criminal policies enacted by the governments of Fernando Henrique Cardoso (1995-2002) and Luiz Inácio Lula da Silva (2003-2010) as well as the government discourses mobilized around the measures adopted. It seeks to investigate the role that the open and imprecise concept of "Organized Crime" has played in the development of such policies. Through a qualitative research on documents, whose results were studied in the light of discourse analysis and criminal policy analysis methodologies, we explore the hypothesis that the paradigm of the "war on Organized Crime" emerged in Brazil after the period of redemocratization and, through hybridization with different rationalities, was mobilized - albeit in different ways - as a key justification for the adoption of measures to increase social control, surveillance, militarization of security and repression in the country during the analyzed period. Proposing a cross-dialogue between Foucauldian and Marxist conceptions of sociological studies on punishment mechanisms and on neoliberalism, and also analyzing the global and American construction of the issue of "Organized Crime" as a governmental problem, this research seeks to contribute to the debates on the occurrence of a "punitive turn" in different contexts of the world with the advent of neoliberalism as the predominant political rationality. Attentive to possible ruptures and continuities, this dissertation studies the movements around the issue and investigates how the changes in Brazil are inserted in broader global processes, highlighting the couplings and reinforcements of these processes with social particularities of the Brazilian case.
