A presente pesquisa analisa o processo de aprovação da Lei Orçamentária Anual (LOA) no âmbito da Câmara dos Vereadores de São Paulo, em duas legislaturas diferentes, abrangendo os anos de 2009 a 2016. A partir da análise das demandas formuladas pelos atores sociais, identificadas através das notas taquigráficas de todas as audiências públicas do período, e do registro de todas as emendas apresentadas e aprovadas pelos vereadores, buscamos responder se a participação social no poder legislativo é, de fato, capaz de influenciar a proposição de emendas orçamentárias e, em última instância, voltamos a análise para a efetividade das audiências públicas, avaliando se essa instituição participativa constitui um canal eficaz para a sociedade interpor demandas. Os achados apontaram que as audiências públicas no legislativo passaram a suprir a ausência de um canal efetivo para a sociedade civil fazer chegar suas demandas, sobretudo no período em que a participação social no Executivo é mais restrita. Em resumo, argumentamos que as audiências públicas, enquanto instituição participativa, consistiram, no período estudado, em uma alternativa de participação aos atores sociais, que haviam perdido um importante canal de intervenção no orçamento público (o orçamento participativo). Por outro lado, quando volta a ocorrer uma maior abertura à participação no âmbito do Poder Executivo, é possível verificar uma queda da participação no Poder Legislativo, mas as audiências públicas orçamentárias continuam com certo sucesso, atendendo importantes reivindicações dos atores sociais, o que demonstra o caráter dinâmico das relações socioestatais.

This research analyzes the approval process of the annual budget law (LOA) at São Paulo City Council, in two different legislatures, between 2009 and 2016. Based on the analysis of the claims made by social actors, identified through shorthand notes of all public hearings in the period, and the record of all budget amendments presented and approved by city representatives, the research purpose is to answer whether social participation in the legislative power is, in fact, capable of influencing the proposal of budget amendments and, in ultimately, we turn to the analysis of the effectiveness of public hearings, evaluating whether this participatory institution is an effective way for society claims. The findings showed that the legislative public hearings started to make up for the lack of an effective way for civil society to interpose its claims, especially in the period in which the social participation in the Executive is more restrict. In summary, we argue that public hearings as a participatory institution consisted in the period studied, in an alternative for the participation of social actors after losing an important intervention channel in the public budget (the participatory budget). On the other hand, when Executive Power opens social participation, it is possible to verify a drop in participation in the Legislative Power, but the budget public hearings continue with some success, meeting important claims of social actors and demonstrating the dynamic character of state-society relations.
