Essa dissertação visa estudar a Agência Nacional do Petróleo, Gás Natural e Biocombustíveis (ANP), a partir do conceito de "capacidade regulatória". O processo de estruturação da agência, desde sua implementação em 1997, no governo Fernando Henrique Cardoso, e sua consolidação nos governos de Luiz Inácio Lula da Silva (2003-2010), demonstraria se há, ou não, capacidade de regulação no setor petrolífero brasileiro. O conceito de capacidade regulatória refere-se, nesse trabalho, às respostas e inovações institucionais no âmbito regulatório do setor petrolífero, especificamente em sua agência reguladora, ocorridas como reflexo de novas demandas colocadas sobre o Estado e suas burocracias. Objetiva-se analisar, com base na capacidade regulatória, as diferentes conformações da ANP. Por último, serão avaliadas as características institucionais da ANP corroboradoras de sua capacidade regulatória.

This dissertation aims to study the National Agency of Petroleum, Natural Gas and Biofuels (ANP), based on the concept of "regulatory capacity". The structuring process of the agency, since its implementation in 1997, under the Fernando Henrique Cardoso government, and its consolidation under the Luiz Inácio Lula da Silva governments (2003-2010), would demonstrate whether or not there is regulatory capacity in the Brazilian oil sector. . The concept of regulatory capacity refers, in this work, to institutional responses and innovations in the regulatory sphere of the oil sector, specifically in its regulatory agency, which occurred as a reflection of new demands placed on the State and its bureaucracies. The objective is to analyze, based on the regulatory capacity, the different conformations of the ANP. Finally, the institutional characteristics of the ANP that corroborate its regulatory capacity will be assessed.
