O presente trabalho tem como tema de investigação a criação de mecanismos e de práticas de controle externo da atividade policial no Brasil, em específico o controle externo da atuação da polícia militar por meio da Lei Federal nº 9.299/96, que transfere para a Justiça Comum os casos de homicídios dolosos praticados por policiais militares no exercício de suas funções. A análise do impacto da lei sobre os números da violência policial, ressaltando tanto suas possibilidades como seus limites como um instrumento de controle externo da atuação da polícia militar é um dos principais objetivos deste trabalho.A hipótese central desta dissertação é a de que a lei, ainda que importante e necessária, mostra-se insuficiente para reduzir os números da violência policial, isto porque ao longo de sua tramitação no Congresso Federal, houve uma distorção do projeto inicial, criando lacunas que favorecem a impunidade dos agentes envolvidos nos casos, como pode ser demonstrado nos processos penais de homicídio doloso cometidos por policiais militares entre 1996 a 1998, e acompanhados pela Ouvidoria de Polícia do Estado de São Paulo

This thesis is about the mechanisms and the practices of externai control over the police activities in Brasil, specifically, the externai control over the military police' s work established by the 9299/96 Federal Law. By this law the judgement of the cases of homicides commited by the military policemen was transferred to the Common Law. One of the principal objectives of this thesis is also to analyse the effect of the 9299/96 Law on the data about the police violence showing both its limites and its possibilities as an instrument of externai control over the military police's activities. The central hypothesis of this thesis is that despite the important and necessary role of the 9.299-96 Law, it has not been efficient enough to reduce the police violence data because the law was modified by the National Congress and generated gaps through which impunity can be detected as it is demonstrated by the analysis of the penal processes of homicides between the years of 1996 and 1998 which were followed up by the Ouvidoria de Policia of São Paulo State
