O presente estudo se propõe a analisar os fatores que interferiram no processo de implantação da norma operacional básica NOB/01 96 no Estado do Espírito Santo tendo como referencial entender e mensurar a influencia da lei estadual nº 5344 de 19 de dezembro de 1996, que estabeleceu um aumento do índice de participação na distribuição do Imposto Sobre Operações Relativas a Circulação de Mercadorias e Sobre Prestação de Serviços de Transporte Interestadual e Intermunicipal e de Comunicação aos Municípios do Estado (ICMS), aos municípios que assumirem a gestão mais avançada do Sistema Único de Saúde. A importância desse estudo é no sentido de compreender os fatores que fizeram do Espírito Santo ser o primeiro Estado da Federação a atingir um índice maior que setenta por cento, sendo trinta e quatro na Gestão Plena do Sistema Municipal de Saúde. A metodologia da pesquisa utilizada foi a qualitativa onde houve um levantamento das informações na Comissão Intergestora Bipartite. Foram realizadas também, entrevistas com gestores e assessores da época do pleito, utilizando para analise das entrevistas, o Discurso de Sujeito Coletivo (DSC). Dentre os quatorze entrevistados evidenciou-se três idéias centrais que levaram os municípios a pleitear a gestão mais avançada do sistema: primeiro por se tratar de um modelo estabelecido pelo ministério da saúde, que permitia aos municípios, organizarem seus serviços após a implantação da gestão (termo de compromisso); segundo por interesse em obter maior autonomia em relação à organização do seu sistema de saúde e a de seus tetos financeiros; terceiro por vislumbrar um maior índice de rateio do ICMS baseado na legislação vigente, aumentando assim a sua arrecadação. Ao final do estudo podemos afirmar que a Lei do incentivo a gestão mais avançada interferiu diretamente na decisão dos municípios principalmente os de menor densidade demográfica. Sendo assim o Governo do Estado, ao criar esse estímulo, conseguiu que os municípios menores estabelecessem expectativas de maiores índices e conseqüentemente maior arrecadação, o que permite maior destinação de recursos para aplicação no município melhorando a qualidade de vida da população.

The present study proposes to analyze the points that could interfere in the action of implantation of law basic operational NOB/01 in the state of ES, having as reference to understand and to measure the influence of state law number 5344 of 19^th December 1996, which established an elevation of participation rate in distribution of operation tax related to 'circulation of goods and to rendering services of interstate and intermunicipal transportation and communication with the cities of the state (ICMS), to the cities that assume the most advanced ministration of SUS. The importance of this study and with the sense of understanding the points which did ES to be the first state of federation that got a higher rate than to per cent, 34 in full ministration of municipal health system the methodology of research used was the qualitative one, where there was a raising of information in interministration commission BIPARTITE, also realized interviews with ministers and attendants by the time that the contest occurred, using for analyzing interviews the speech of collective subject (DSC) among four teen interviewers, showed three main ideas that let the cities to plead the most advanced ministration of system first for being about a n established model by ministry of health, which allows the cities organizing their services after the implantation of ministration (compromise term), after for the benefit of obtaining a bigger autonomy related to the organization of its system of health and to its financiai ceiling, third for glimpsing a bigger rate of apportionment of ICMS based on actual legislation, increasing its warehouse . At the end of the study we can assure that incentive law to the ministration most advanced interfered directly on cities decisions mainly the ones with less demographic density, this being the case of state government by creating this stimulus, got that the smaller cities established expectations of bigger rates and consequently bigger warehouse, that allows a greater destination of sources to the application in the city, improving the population's quality of life.
