Execução da análise relativa à efetividade da promoção de políticas públicas por meio dos instrumentos dispostos no Estatuto da Cidade, e sua aplicabilidade no planejamento ambiental urbano. Visa estabelecer um quadro propositivo de integração do planejamento, esquadrinhando a sistemática constitucional de distribuição de competência entre os entes federados, para determinar os vetores legais que viabilizem a integração das políticas setoriais, urbanas e de meio ambiente. No exame da viabilidade da Política Urbana ser instrumento de planejamento e gestão ambiental urbanos, perfez-se a evolução histórica e modo de produção do espaço urbano no país, via ocupação territorial, ciclos econômicos e políticos, que geraram o quadro atual de ocupação demográfica e fenômeno urbano. Para contemplar a sustentabilidade do planejamento urbano, pela via da integração da política urbana com a política ambiental, foi oferecida uma visão da evolução da tutela jurídica do meio ambiente, ressaltando a interferência do Direito Internacional no Direito Ambiental pátrio, expô-se a distribuição de competência dos entes federados, como assumida pela Magna Carta vigente, apresentou-se a Política Urbana, traduzida pelo Estatuto da Cidade, bem como se delineou a função socioambiental da propriedade. Foram expostos instrumentos de gestão ambiental urbana e os instrumentos de planejamento urbano. No que conceme à ocupação do espaço urbano periférico, expansão urbana e proteção ambiental, destacouse a diretriz de regularização fundiária de áreas urbanas irregularmente ocupadas, bem como o planejamento e a oferta de infra-estrutura para as mesmas, com o intuito de demonstrar a faclibilidade da integração das políticas, assumido o viés ambiental e a mobilização social. Considerando a premissa segundo a qual a degradação ambiental e a exclusão social são aliadas na expansão dos aglomerados urbanos, e que a Justiça Social é o tema central da sustentabilidade, parte-se da implementação de políticas públicas tais como a que norteia o planejamento urbano para propor uma face sistêmica ao equacionamento dos graves problemas sociais e ambientais das cidades brasileiras. Planejamento setorial estanque e dissociado do todo tem menor potência de aferição de resultados.

The objective of the present work is to promote a relative analysis of the effectiveness of the promotion of public policies by the instruments related in the City's Statute, and its applicability in the urban environment planning. It also aims to establish a proposal for integration of the planning, with a systematic investigation of the constitutional distribution competence between the federated beings, to determine the legal directions that make possible the integration of the sector, urban and environment policies. Environment degradation and social exclusion work together to expand the urban agglomeration and the Social Justice is the central subject of the sustainability. Considering this premise, public policies are created, as the one that guides the urban planning, to propose a systemic sotution to the serious social and environmental problems of the Brazilian cities. The sectors planning are treated as it selves and not as a whole so, it has minor results. Once the Urban Policies viability was used as an instrument of urban planning and environmental management, the historical evolution and the way the urban space was produced in the country lead us, by territorial occupation and economic and political cycles, to the current map of demographic occupation and urban situation. To contemplate the sustainability of the urban planning, by the urban and environmental policies integration, we show the evolution of the legal protection to the environment, standing out the interference of the Intemational law in native environmental law. We expose the competence distribution of the federated beings, as assumed in the actual constitution, the Urban Policies, translated from the City's Statute, as well the social and environmental function of the property, the instruments of urban environment management and urban planning. In the matter of the peripheral urban area occupation, urban expansion and environment protection, the agrarian regularization of irregularly occupied urban areas in an important step, as well the planning and the infrastructure offers for it, with intention to demonstrate the real possibility of the policies integration, assumed the environment and social aspects.
