Objetivo. O presente estudo teve como objetivo central a análise dos principais aspectos conceituais e fatores intervenientes na regulação da prestação dos serviços de saneamento básico, visando gerar subsídios para a formulação de políticas de regulação por parte do poder público. Método. Foi realizada uma pesquisa exploratória, baseada em delineamentos bibliográfico e documental, sobre o atual cenário institucional do setor de saneamento básico, incluindo á atuação dos diversos agentes públicos responsáveis pela formulação e implementação das políticas setoriais, bem como sobre o processo de reestruturação institucional no qual é proposta a implantação de um marco regulatório para a prestação dos serviços de saneamento básico, visando aprimorar o estado atual do conhecimento e, eventualmente, preencher lacunas existentes. Desenvolvimento do tema. A análise realizada procurou contextualizar o tema no âmbito da redefinição do papel do Estado na economia, que tem como conseqüência imediata a reordenação institucional dos setores de infra-estrutura (incluindo o de saneamento básico), através do surgimento de novas instâncias institucionais, como os órgãos reguladores, compatíveis com as necessidades da nova regulamentação que se vem implantando nesses setores, bem como pela participação cada vez maior do capital privado nos mesmos. Para tanto, foi realizada uma abordagem do atual cenário institucional do setor de saneamento e da articulação desse com os setores afins (recursos hídricos, saúde pública e meio ambiente), foram discutidos os principais aspectos referentes aos serviços de saneamento, para em seguida discorrer sobre a redefinição do papel do Estado na economia e suas conseqüências sobre o referido setor, bem como sobre os principais conceitos embasadores e aspectos relevantes de uma política de regulação. Conclusões. A inexistência de um arcabouço legal, que contemple a reordenação institucional do setor de saneamento básico, da forma como ocorreu com os setores de telecomunicações e energia elétrica, e que defina com clareza as atribuições e competências das três esferas administrativas, bem como as relações entre poder concedente, prestador dos serviços e agente regulador, é o principal entrave à construção de uma estrutura regulatória eficiente e que se proponha a perseguir os objetivos de universalização do atendimento à população, auto-sustentabilidade dos serviços, melhoria contínua da eficiência gerencial e operacional, e estabilidade e continuidade da prestação dos serviços.

Objective. The purpose of the present study is to analyze the most important conceptual aspects and factors related to the regulation of water and sewerage utilities and to contribute to the working up of public regulatory policies. Method. An exploratory research of bibliography and documents was developed to make clear the institutional framework of the water and sewerage sector, including the performance of a number of public agencies in their activities of elaboration and implementation of sector policies, as well as the process of institutional reforms to implant a regulatory framework for the sector. The intention has been to obtain a picture of the state of the art of water and sewerage activities regulation and to make some suggestions in order to contribute to the improvement of the same regulation. Theme development. The initial focus of the analysis was the redefinition of the role of government in the economy, which has originated an institutional rearrangement of the infrastructure sectors (including water and sewerage sector), as the coming out of new regulatory agencies and the enlargement of private sector participation. The institutional setting of the water and sewerage sector and the relationship between this sector and linked areas (water resources management, public health and environment), as well as the main aspects of the water and sewerage industry, are then put in the context of the analysis, so as to assess the impact of the redefinition of the role of government in the economy in the sector and the basic ground for an adequate regulatory policy. Conclusions. The principal impediment to an efficient regulatory policy and its main targets, which are the widespread of water and sewerage services, the self-sufficiency of the industry, the continuous improvement of managerial and operating efficiency, and the stable continuity of the services, is the inexistence of a legal framework to control the institutional rearrangement of the sector and to set the rules of the relationship between local and state government, industry and regulatory agencies.
