A tese refere-se à construção de uma barragem para contenção de rejeitos de uma mineradora na Região Metropolitana de Curitiba, Município de Cerro Azul, PR e ao conflito gerado entre população e empreendimento, com vistas a eventuais danos ambientais provocados por essa atividade. Foram levantados dados físico-químicos e biológicos procurando-se caracterizar a qualidade sanitária e ecológica do rio Pinheirinho, no qual está instalada a barragem, no rio Ribeira, principal tributário da bacia hidrográfica, bem como na própria barragem de rejeito. Foram discutidos também aspectos da toxicidade do efluente da indústria que trabalha com beneficiamento de fluorita. Para tanto, foram levantados dados bibliográficos e realizados bio-ensaios para verificar os eventuais efeitos agudos e crônicos sobre a fauna aquática. Foram considerados os aspectos legais concernentes ao estudo do caso em tela, particularmente aqueles que dizem respeito aos interesses difusos da população, além das normas relativas ao licenciamento ambiental que regulam as atividades do IAP - Instituto Ambiental do Paraná, antiga SUREHMA - Superintendência de Recursos Hídricos do Meio Ambiente. A análise dos dados físico-químicos e biológicos mostrou um ecossistema aquático no qual a biota mantém inalterados os vários elos da cadeia alimentar e que os habitantes encontrados são indicadores de água onde o equilíbrio ecológico e sanitário fica evidente. Quanto aos testes de toxicidade aguda nos pontos amostrados no rio Pinheirinho, à montante e à jusante da barragem de rejeito, constatou-se a ausência de toxicidade aguda. Entretanto, nas águas do rio Ribeira essa toxicidade está presente antes e após a desembocadura do rio Pinheirinho evidenciando que os efluentes da atividade mineradora estudada, não interfere na qualidade da água desse corpo d'água. A análise da legislação discutiu a denúncia formulada contra o empreendimento, as diversas normas legais relativas ao caso, particularmente aquelas que dizem respeito às classes dos corpos d'água e a questão do licenciamento ambiental. Foram feitas recomendações para realização de um monitoramento anual das águas do rio Pinheirinho como medida preventiva de segurança da qualidade da água desse corpo hídrico.

The thesis refers to the construction of a dam to contain residues from a mining company in the metropolitan region of Curitiba, the Cerro Azul County, PR and the conflict generated between the population and the enterprise, regarding possible environmental damage caused by this activity. Physical-chemical and biological data were obtained with the objective of characterizing the sanitary and ecological quality of the Pinheirinho river in which area the dam was built, in the Ribeira river, the main tributary of the hydrographic basin, as well as the residue reservoir. Also, the aspects of the toxicity of the effluent of the fluorite processing industry were discussed. Therefore, literature data was collected and bio-tests were carried out to quantify possible acute and chronic effects on the aquatic fauna. The legal aspects applicable to this case study were taken into account, particularly those which refer to the diffuse interests of the population, besides the environmental licensing laws which regulate the activities of IAP - Instituto Ambiental do Paraná (Parana's Environmental Institute), previously SURHEMA. The analysis of the physical-chemical and biological data showed an aquatic ecosystem in which the biotas maintain unchanged the diverse links in the food chain and that the inhabitants found are indicators of a water in which the ecological and sanitary equilibrium is evident. Regarding the acute toxicity tests at the sampling points of the Pinheirinho river, both upstream and downstream of the residue reservoir, acute toxicity was not found. However, in the waters of the Ribeira river said toxicity is present before and after the mouth of the Pinheirinho river, evidencing that the studied effluents of the mining activities do not interfere in the water quality of this water body. The analysis of the legislation discussed the accusation made against the enterprise and several legal instruments applicable to the case, especially in regard to the classification of the water bodies and the question of the environmental licensing. Recommendations were made regarding a yearly monitoring of the waters of the Pinheirinho river as a preventive safety measure of the water quality of this hydric body.
