O setor privado de educação superior representa quase 90% de todas as instituições deste nível educacional do Brasil (MEC/Inep, 2021). Para influenciar os detentores do poder e trazer vantagens para a iniciativa privada, uma das estratégias do setor é a participação por meio das entidades da Sociedade Civil que o representa em todas as arenas decisórias, inclusive dentro das Comissões Permanentes do Poder Legislativo. Nesta direção, o estudo tem como objetivo analisar a participação e a influência do setor privado de educação superior, por meio dos seus representantes, durante as audiências públicas da Comissão de Educação da Câmara dos Deputados, no período entre 1995 e 2018. O fato de as Comissões Permanentes possuírem poder terminativo sobre determinados projetos de lei evidencia a importância deste recurso e a relevância da participação de grupos de interesses dentro dessa arena decisória. Trata-se de uma pesquisa documental crítico-descritiva, que se fundamentou na Teoria do Estado Ampliado e no método da Análise do Discurso, e tratamento das fontes documentais a partir do emprego da técnica de análise documental. A abordagem empregada foi qualitativa. Constatou-se que as principais entidades representativas do setor privado de educação superior, para influenciarem os processos decisórios, precisam de uma legitimação política em ambiente institucional (a audiência pública), tornando possível a inserção de interesses na agenda política. Essa legitimidade é construída a partir da relação das entidades representativas com os Deputados Federais que compõem a Comissão de Educação (inclusive com financiamento de campanha), com os autores dos projetos de lei e na forma como os discursos em audiências públicas são proferidos. As audiências públicas são importantes para o setor privado de educação superior pois são canais institucionalizados e efetivos de intermediação de interesses, de modo que os empresários se posicionam e defendem interesses particulares, saindo-se vitoriosos nas audiências públicas e, posteriormente, na pressão realizada pelos corredores das comissões com fins a influenciarem as decisões políticas na maior quantidade de lugares possível, incluindo a Comissão de Educação da Câmara dos Deputados.

The higher education private sector represents almost 90% of all institutions of this educational level in Brazil (MEC/Inep, 2021). In order to influence the holders of power and bring advantages to the private sector, one of the sector's strategies is the participation through civil society entities that represent it in all decision-making arenas, including within the Permanent Commissions of the Legislative Power. In this direction, the study aims to analyze the participation and influence of the private sector of higher education, through its representatives, during the public hearings of the Education Commission of the Chamber of Deputies, in the period between 1995 and 2018. the Permanent Commissions having final power over certain bills shows the importance of this resource and the relevance of the participation of interest groups within this decision-making arena. This is a critical-descriptive documentary research, which was based on the Theory of the Extended State and on the Discourse Analysis method, and treatment of documentary sources using the document analysis technique. The approach used was qualitative. It was found that the main entities representing the private sector of higher education, in order to influence the decision-making processes, need political legitimation in an institutional environment (the public hearing), making it possible to insert interests in the political agenda. This legitimacy is built from the relationship between the representative entities and the Federal Deputies that make up the Education Commission (including campaign funding), with the authors of the bills and in the way in which the speeches in public hearings are delivered. Public hearings are important for the private sector of higher education as they are institutionalized and effective channels of intermediation of interests, so that the private sector takes a stand and defends particular interests for higher education policies in Brazil.
