A presente dissertação objetivou compreender de que modo as desigualdades são consideradas pelos Estados nacionais nas formulações de políticas públicas direcionadas às pessoas com deficiência, a partir da análise de documentos normativos internacionais. Sabendo que as pessoas com deficiência constituem um dos grandes grupos desiguais e a trama de desigualdades que as afeta tem causas variadas e complexas, utilizou-se como referencial teórico autores da área da sociologia, ciências sociais, filosofia, história, psicologia, medicina, para promover uma discussão acerca das desigualdades, diferenças e deficiências. Por meio de análise documental e de conteúdo de documentos internacionais destinado aos Estados nacionais para elaboração de políticas públicas, procurou-se compreender como se estrutura o combate às desigualdades vivenciadas pelas pessoas com deficiência como forma de garantia de direitos. Observa-se, a partir dessa análise, três formas que esse combate pode ser norteado: objetivando as igualdades de oportunidades; visando a igualdade no gozo de direitos; e, pela promoção da inclusão. Cada uma delas apresenta possibilidades e limites específicos, mas conclui-se que a igualdade de oportunidades e a promoção da inclusão tendem a reduzir as diversas desigualdades à desigualdade de acesso. Ainda, a inclusão, tida como princípio, caminho e meta na garantia de direitos, tende a camuflar as assimetrias nas relações desiguais ao transformar o combate às desigualdades em um combate contra a exclusão. Logo, a igualdade no gozo de direitos parece ser um norteador mais eficiente no combate às desigualdades que afetam as pessoas com deficiência, pois torna explícito que essas pessoas são detentoras dos mesmos direitos que todos e sinaliza que elas não conseguem usufruir desses direitos da mesma forma e intensidade que os outros, tornando evidentes as desigualdades e situações de injustiça vivenciadas por elas.

This dissertation aims to understand how inequalities are considered by the national States in the formulation of public policies directed at people with disabilities, based on the analysis of international normative documents. Knowing that people with disabilities constitute one of the major unequal groups and the range of inequalities that affect them has causes that are both varied and complex, authors from the fields of sociology, social sciences, philosophy, history, psychology, medicine were used as theoretical references to promote a discussion about inequalities, differences and disabilities. The analysis of international documents destined to the national states for the elaboration of public policies enabled the comprehension of how the fight against inequalities experienced by people with disabilities is structured as a way of guaranteeing rights. This analysis leads to three possible guidelines: aiming at equalization of opportunities; aiming at equality in the enjoyment of rights; and by promoting inclusion. Each has specific possibilities and limits, but it is concluded that equalization of opportunities and promoting inclusion tend to reduce the various inequalities to inequality of access. Moreover, inclusion, taken as a principle, path and goal in guaranteeing rights, tends to camouflage the asymmetries in unequal relations by turning the fight against inequality into a fight against exclusion. Thus, equality in the enjoyment of rights seems to be a more efficient guide in fighting the inequalities that affect people with disabilities, since it makes it explicit that they have the same rights as everyone and signals that they are unable to enjoy these rights in the same way and intensity as the others, making evident the inequalities and situations of injustice experienced by them.
