Questões emergentes no âmbito da Defensoria Pública relacionam-se, entre outras, às ações que possam se voltar à garantia de direitos das pessoas em sofrimento mental e/ou que fazem uso problemático de drogas e de suas famílias. Neste sentido, objetiva-se, neste trabalho, identificar situações ligadas à saúde mental que emergem no campo da Justiça e refletir acerca das práticas delas decorrentes, tendo como ponto de partida as histórias que chegam à Defensoria Pública do Estado de São Paulo (DPESP). Nessa linha, algumas das questões norteadoras foram: as ações desenvolvidas como decorrência das políticas públicas estão alinhadas com os ideais da luta antimanicomial, no sentido de promover práticas de cuidado e garantidoras de direitos das pessoas em sofrimento mental? Quais profissionais e serviços estão envolvidas/os no desenvolvimento dessas ações? Para alcançar os objetivos propostos, foram feitas: revisão bibliográfica sobre a ideia de loucura em nossa sociedade; levantamento de documentos oficiais e elaboração de um diário de campo. Neste foram anotados casos atendidos, situações e atividades institucionais vivenciadas pela pesquisadora, que também é psicóloga e trabalhadora na DPESP. Retratos do cotidiano elaborados a partir das anotações, permitiram aproximação ao fenômeno estudado e trouxeram elementos que foram analisados a partir de referenciais teóricos que problematizam a ideia de loucura e de áreas psi oriundos, principalmente, do campo da Saúde Mental e da Psicologia Social inscrita na crítica à vida cotidiana. Ao se debruçar sobre leis, normativas e práticas que foram sendo construídas e reconstruídas ao longo dos anos, pode-se perceber transformações, que nem sempre têm reflexo na vida das pessoas. Há diferentes interesses em jogo, diferentes modelos, uns aparentemente mais ou menos propulsores de saúde. Em certos momentos, o velho parece retornar como novo. O manicômio retorna em outras vestimentas, com outros discursos. Apesar de ter estruturas que parecem repetir o antigo, a Defensoria Pública apresenta novidades: espaços de diálogo, espaços de escuta, espaços de discussão, espaços de reflexão e construção. À Psicologia é possível ver outras expectativas que não categorizar pessoas, lugar tão comum nesta interface com a Justiça. É possível estar junto às pessoas e aos outros serviços que as acompanham. Assim, vê-se que, após a entrada de psicólogas/os na Defensoria Pública, outras possibilidades de atuação foram sendo pensadas e construídas, sobretudo na prática: nos atendimentos, nas relações, no trabalho multiprofissional, quando este teve espaço e horizontalidade para acontecer

Emerging issues within the scope of the Public Defender's Office relate, among others, to actions that can focus on guaranteeing the rights of people in mental distress and / or who make problematic use of drugs and their families. In this sense, the objective of this work is to identify situations related to mental health that emerge in the field of Justice and reflect on the practices arising from them, taking as a starting point the stories that reach the Public Defender of the State of São Paulo (DPESP). Along these lines, some of the guiding questions were: are the actions developed as a result of public policies aligned with the ideals of the anti-asylum struggle, in the sense of promoting care practices and guaranteeing the rights of people in mental suffering? Which professionals and services are involved in the development of these actions? In order to achieve the proposed objectives, the following were carried out: bibliographic review on the idea of madness in our society; survey of official documents and preparation of a field diary. In this case, cases attended to, situations and institutional activities experienced by the researcher, who is also a psychologist and worker at DPESP, were noted. Portraits of the quotidian elaborated from the notes, allowed approximation to the studied phenomenon and brought elements that were analyzed from theoretical references that problematize the idea of madness and psi areas originating, mainly, from the field of Mental Health and Social Psychology inscribed in the critique of everyday life. When looking at laws, regulations and practices that have been built and rebuilt over the years, one can perceive transformations, which are not always reflected in people's lives. There are different interests at play, different models, some apparently more or less health-promoting. At certain times, the "old" seems to return as "new". The asylum returns in other clothes, with other speeches. Despite having structures that seem to repeat the old, the Public Defender presents novelties: spaces for dialogue, spaces for listening, spaces for discussion, spaces for reflection and construction. In Psychology it is possible to see other expectations than to categorize people, a place so common in this interface with Justice. It is possible to be with the people and other services that accompany them. Thus, it appears that, after the entry of psychologists in the Public Defender's Office, other possibilities of action were being thought and built, especially in practice: in care, in relationships, in multidisciplinary work, when it had space and horizontality to happen
