Atualmente, chama a atenção o elevado número de casos em que o pai ingressa como requerente na justiça, solicitando a guarda ou demandando maior participação na vida dos filhos. Não obstante o advento da Guarda Compartilhada (2014) que versa sobre a obrigatoriedade de sua aplicação (quando não houver acordo entre os pais), a criança continua residindo em um dos lares, sendo determinado, pelo juiz, o período de convivência com o(a) genitor(a) com o qual não reside. Sobretudo em casos altamente litigiosos (em que há grande conflito) muitas vezes o juiz determina auxílio de outros profissionais, como psicólogos e assistentes sociais, a fim de subsidiar a sua decisão. Na perícia psicológica é requisitado do profissional um posicionamento claro acerca de qual dos genitores reuniriam melhores condições de assumir a guarda fática do filho. Questiona-se, entretanto, se existem critérios científicos e imparciais que fundamentariam um parecer desse tipo. O que se observa, na prática, é a influência de preconcepções de ordem moral e pessoal do próprio perito, quando ele toma como base modelos de paternidade e maternidade que considera como verdadeiros e atemporais, deixando de levar em conta que tais modelos são socialmente construídos. Através da presente pesquisa, procurou-se oferecer um lugar de escuta aos pais que requerem a guarda, para que dissessem de si mesmos e do seu pleito. Pretendeu-se, com isso, contribuir para uma avaliação menos contaminada por conceitos pré-estabelecidos, e disposta a acolher o novo. Através dos conceitos psicanalíticos de função materna e função paterna, pôde-se chegar a uma compreensão desses pais que vai além do que é socialmente determinado como função de cada genitor, trazendo contribuição ao tema em questão, além de certa fundamentação teórica aos profissionais que lidam diariamente com esta demanda

Nowadays, the high number of cases in which the father goes to court, claiming for custody or demanding greater participation in their children's lives, draws attention. Regardless of the advent of the Shared Custody (2014), which asserts the obligation to apply it (when there is no agreement between the parents), the child continues to reside in one of the homes, being determined, by the judge, the period of coexistence with the parent whom does not reside. Especially in highly contentious cases (in which there is a great deal of conflict) the judge often determines support of other professionals, such as psychologists and social workers, in order to subsidize their decision. At the "psychological expertise" the professional is asked to take a clear position on which of the parents would be better able to take the factual custody of the child. However, it is questioned whether there are "scientific and impartial" criteria that would justify such conclusion. What is observed, in practice, is the influence of moral and personal preconceptions of the expert himself, when he takes as a basis models of paternity and maternity that he considers to be true and timeless, failing to take into account that such models are socially constructed. Through the present research, it was offered a place of listening to the fathers who require the guard, so that they could say about themselves and their litigation. The intention was to contribute to an "evaluation" less contaminated by pre-established concepts, and willing to welcome the new. Through the psychoanalytic concepts of maternal function and paternal function, it was possible to achieve an understanding of these parents that goes beyond what is socially determined as a function of each parent, bringing contribution to the topic in question, besides a certain theoretical foundation for the professionals who deal with this demand
