Estuda os fundamentos constitutivos da instituição penitenciaria e de suas ciências clinico-criminológicas a partir de um lugar situado no polo prisioneiro da relação prisão/presidiário. Junto a pessoas aprisionadas examina, os enganos cometidos durante o desenvolvimento de um estudo sobre os recursos de resistência de presidiários ao controle carcerário. Retoma alguns momentos cruciais do processo de construção dos fundamentos dos saberes penitenciários, para examina-los dentro de cenários e contextos histórico-sociais especialmente evocados a partir de um ponto de vista prisioneiro. Resulta num modelo que permite entender as ações e a própria constituição da prisão e de suas ciências como um sistema de guerra que tem por inimigo não o crime, mas os prisioneiros pobres e toda sua população de origem

This paper deals with the basic componentes of penal institutions and criminological as well as clinical sciences from the point placed upon the prisioner´s pole of the prision/prisoner relationship. Point of inflection of a long research experience with prisioners, this thesis begins with an examination of the errors committed during the development of a previous study of prisioners resistance mechanisms to prison control. This analysis aims to correct the focus, and goals of the study in question. As a consequence of this inversion, this analysis returned to crucial moments in the process of the acquisition of official knowledge in penal institutions in order to examine prisioners points of view within a social and historical context. As a result, we have developed a model that permits an understanding of the penal institution, its knowledge and actions, as a war whose opponent is not crime, but rather destitute prisioners and the social class from wich they derive
