Esta tese analisa como o Brasil dá consequência aos enunciados que ele mesmo se impõe no plano jurídico formal em relação ao campo da comunicação e especificamente ao acesso à internet, e porque isso o ocorre, sob a perspectiva das narrativas teóricas que alimentam essa possível contradição entre os direitos proclamados e o modelo regulatório implementado nas telecomunicações com qual temos convivido desde o final da década de 1990. A hipótese que se busca investigar é que embora os direitos ligados ao campo da comunicação tenham avançado substancialmente, inclusive com a garantia do direito de acesso à internet, as políticas públicas dos últimos 20 anos não deram consequências e esses mandamentos legais, reforçando um modelo excludente e desigual. E que essa contradição é alimentada por uma visão historicamente construída também no plano das ideias, com teoria da regulação e teoria sobre a formação do Brasil se reforçando mutuamente. Para isso, reconstitui-se a evolução estrutural das telecomunicações, sob o aspecto técnico e regulatório e dos enunciados de direitos fundamentais e ela vinculadas, com foco em dois períodos (1960-1990 e 1990-2020), com a apresentação de indicadores para uma avaliação do modelo atual. Apresentam-se pontos de contato entre teoria da regulação e teóricos de formação do Brasil, buscando verificar o pano de fundo que legitimou a privatização das telecomunicações e que impede a consecução de políticas universais de acesso. A metodologia utilizada foi majoritariamente a exploração bibliográfica e a reconstituição histórica por meio de documentos diversos, além reunião de dados específicos e de um grupo de entrevistas. A tese confirma a forte contradição entre enunciados jurídicos de cunho principiológico e modelo regulatório atualmente vigente e conclui que essa contradição é tornada oculta pela combinação de narrativas teóricas.

This thesis analyzes how Brazil gives effect to the statements that it imposes itself on the formal legal plane in relation to communications field and specifically to internet access, and why this occurs, from the perspective of the theoretical narratives that feed this possible contradiction between the proclaimed rights and the regulatory model implemented in telecommunications since the late 1990s. The hypothesis to be investigated is that although the rights related to the communications field have advanced substantially, including the guarantee of the right of access to the internet, public policies of the last 20 years have not resulted in consequences and these legal mandates, reinforcing an excludent and uneven model. And that this contradiction is fueled by a vision historically constructed also in terms of ideas, with theory of regulation and theory on the formation of Brazil mutually reinforcing each other. For this, the structural evolution of telecommunications is reconstituted, under the technical and regulatory aspect, and the enunciations of fundamental rights linked to it, focusing on two periods (1960-1990 and 1990-2020), with the presentation of indicators for an evaluation of the current model. Points of contact between regulation theory and theorists on the formation of Brazil are sought, seeking to verify the background that legitimized the privatization of telecommunications and that prevents the achievement of universal access policies. The methodology used was mostly bibliographic exploration and historical reconstruction through various types of documents, in addition to gathering specific data and a group of interviews. The thesis confirms the strong contradiction between legal statements of principiological nature and the current regulatory model and concludes that this contradiction is hidden by the combination of theoretical narratives.
