Investiga as relações entre Biblioteca e contextos prisionais, sob a perspectiva dos direitos inalienáveis de todos à educação e à cultura, conforme prevê a legislação brasileira. Especificamente, traça o histórico das leis, recomendações e diretrizes sobre as bibliotecas em prisões, bem como o panorama das pesquisas relacionadas à temática; apresenta histórico da prisão, destacando o contexto nacional. Toma como dados de pesquisa relatos de experiências da pesquisadora como voluntária em unidades prisionais do Estado de São Paulo, entre 2014 e 2021. Para tanto, utiliza-se do método indiciário, proposto por Carlo Ginzburg, resgatando e analisando indícios, pistas e sintomas extraídos de sua atuação em diferentes ações em presídios e expostos sob diferentes formas ao longo do trabalho. A partir dos relatos, são interrogadas as práticas sociais envolvendo as bibliotecas, averiguando-se se elas obedecem às recomendações legais, se estão em conformidade com premissas da educação e cultura, consideradas direito inalienável de todos os cidadãos do País, tanto em situação de liberdade quanto aprisionados. Conclui que as práticas envolvendo bibliotecas em presídios ferem direitos de educação e cultura das pessoas presas, pois, são, via de regra, oferecidas a pequenos grupos, pouco representativos de todo o contingente prisional do País, além de apresentarem lacunas e restrições quanto às concepções de biblioteca e suas dinâmicas gerais em contextos prisionais. Assim, a prisão, além de lugar de exceção e de agudização de conflitos de várias ordens, inscreve-se em um continuum de negação de direitos observados na ordem social ampla, duplica exclusões, seja por negação de direitos previstos em documentos legais, seja pela precarização de direitos de várias espécies produzida pela ordem prisional e suas diferentes estratégias, condições, modos de ordenação e atuação.

Investigates the relations between library and prison contexts, from the perspective of the inalienable rights of all to education and culture, as provided by the Brazilian legislation. Specifically, it traces the history of laws, recommendations and guidelines about libraries in prisons, as well as the panorama of researches related to the theme; it presents the history of prison, highlighting the national context. It takes as research data reports of experiences of the researcher as a volunteer in prison units of the State of São Paulo, between 2014 and 2021. For this, it uses the indicative method, proposed by Carlo Ginzburg, retrieving and analyzing indications, clues and symptoms extracted from her performance in different actions in prisons and exposed in different forms throughout the work. Based on the reports, the social practices involving the libraries are questioned, ascertaining whether they comply with the legal recommendations, whether they are in conformity with the premises of education and culture, considered an inalienable right of all citizens of the country, both free and imprisoned. It concludes that the practices involving libraries in prisons hurt the rights of education and culture of the imprisoned, since they are, as a rule, offered to small groups, little representative of the entire prison contingent of the country, besides presenting gaps and restrictions as to the conceptions of library and its general dynamics in prison contexts. Thus, the prison, in addition to being a place of exception and aggravation of conflicts of various kinds, is part of a continuum of denial of rights observed in the wider social order, duplicating exclusions, either by denial of rights provided for in legal documents, or by the precariousness of rights of various kinds produced by the prison order and its different strategies, conditions, modes of organization and action.
