A presente pesquisa teve por objetivo identificar e analisar os direitos e as garantias fundamentais contidos nas normas constitucionais e infraconstitucionais de proteção ao indivíduo idoso e relacionar com as políticas públicas para reabilitação oral. Além dos fatores que interferem no acesso da população idosa aos serviços de saúde bucal. O percurso metodológico foi desenvolvido em 3 etapas: a) referencial do direito à saúde e a saúde bucal com base no Estatuto do Idoso e no Programa Brasil Sorridente; b) análise crítica entre as necessidades dos idosos quanto ao uso de próteses, número de próteses dentárias produzidas pelos laboratórios do Centros de especialidades Odontológicas (CEOs) e análise documental; c) análises textuais de normas jurídicas e estudos de práticas discursivas aplicada à legislação Constitucional e Infraconstitucional textos correlatos a pesquisa. Após coleta de dados e análise crítica, ficou evidenciado que saúde dos idosos não vem sendo contratada conforme determina a legislação Constitucional e Infraconstitucional com suas consequências biológicas e sociais. O Estado assegura na legislação direitos que na realidade pouco oferece, como se observa na necessidade de reabilitação oral da grande maioria de idosos. Embora haja políticas públicas para reabilitação oral do indivíduo, muitos idosos continuam sem ter acesso a este direito. A ausência efetiva da ação estatal no tratamento e prevenção das doenças bucais retiram do cidadão a dignidade humana e prejudica a qualidade de vida. Concluiu-se que a reabilitação oral do idoso é respaldada na Constituição Federal e no Estatuto do Idoso como direito, mas não vem sendo executada com ampla cobertura. O idoso brasileiro necessita da ampliação do acesso ao tratamento odontológico especializado na rede pública e incentivo educativo nos cuidados com a higiene bucal.

This research aimed to identify and analyze the fundamental rights and guarantees contained in the constitutional and constitutional infra rules for the protection of elderly individuals and to relate them to public policies for oral rehabilitation. In addition to the factors that interfere in the elderly population's access to oral health services. The methodological path was developed in 3 stages: a) referential of the right to health and oral health based on the Elderly Statute and the Brasil Sorridente Program; b) critical analysis between the needs of the elderly regarding the use of prostheses, number of dental prostheses produced by the laboratories of the Dental Specialties Centers (CEOs) and documentary analysis; c) textual analyzes of legal norms and studies of discursive practices applied to Constitutional and constitutional infra legislation - texts related to research. After data collection and critical analysis, it became evident that the health of the elderly has not been contracted as determined by the Constitutional and constitutional infra legislation with its biological and social consequences. In the legislation, the State guarantees rights that in reality offer little, as can be seen in the need for oral rehabilitation of the vast majority of elderly people. Although there are public policies for oral rehabilitation of the individual, many elderly people still do not have access to this right. The effective absence of state action in the treatment and prevention of oral diseases removes human dignity from the citizen and impairs the quality of life. It was concluded that oral rehabilitation for the elderly is supported by the Federal Constitution and the Elderly Statute as a right, but it has not been carried out with wide coverage. The elderly Brazilian needs to expand access to specialized dental treatment in the public network and educational incentive in the care of oral hygiene.
