A arbitragem enfrenta o problema, enquanto instrumento extraprocessual de resolução de litígios, de como vincular o árbitro à execução do seu dever e, consequentemente, como responsabilizá-lo por violar esse mesmo dever; uma vez que, sem solucioná-lo, não há garantia de que aquela controvérsia será efetivamente decidida. Este trabalho investiga a maneira pela qual o direito romano respondeu ao problema. Assim, analisa-se os elementos constitutivos da arbitragem privada romana, o compromissum celebrado entre as partes e o receptum arbitrii celebrado entre as partes e o árbitro , procurando identificar a dinâmica jurídica que os permeava e as consequências normativas perante a responsabilidade do árbitro. Fundamental nesse sentido foi o estudo sobre o edito do pretor e seu tratamento da matéria, cuja rubrica reconstruída indica uma promessa de responsabilidade administrativa contra o árbitro, precluindo o exercício de uma ação e de uma responsabilidade jurisdicional. Tentou-se buscar as razões desse especial tratamento, em uma análise mediante um paralelo com o iudex e arbiter do processo judicial ordinário e com a responsabilidade por litem suam facere a que estes estavam sujeitos, para, daí, extrair algumas conclusões sobre a responsabilidade do árbitro e sua relação com a dinâmica de risco que repousava sobre as partes

As an alternative instrument of dispute resolution, arbitration faces the problem as to how to bind the arbiter to his duty and, consequently, how to make himself liable for the violation of those same duties; since, without a solution to this problem, there is no assurance that the controversy would be decided. This work investigates the way by which roman law has answered this particular problem. Therefore, it analyses the fundamental elements of roman private arbitration, the compromissum concluded between the disputing parties and the receptum arbitrii concluded between the parties and the arbiter , trying to identify the legal dynamic that ran through them and the normative consequences for the arbiters liability. Fundamental was the study of the praetors edict and its handling of the subject, whose reconstructed section indicates a promise of administrative liability against the arbiter, excluding the exercise of an action and the jurisdictional liability. It was made an effort to search for the reasons of this special treatment, through an analysis of the iudex and arbiter from the ordinary judicial procedure and the liability by litem suam facere to which those individuals were submitted, in order to extract some conclusions about the private arbiters liability and his relationship with the risk dynamic that lay amongst the parties.
