O tribunato da plebe foi fundamental para garantir a liberdade dos plebeus e para o amadurecimento das instituições republicanas em Roma. Os tribunos, principalmente utilizando a intercessio, atuavam em prol da plebe e contribuíram, direta e indiretamente, na modificação do ordenamento jurídico-constitucional romano com o intuito de possibilitar uma atuação mais efetiva dos plebeus. O presente trabalho analisa como os plebeus, sem participação ativa no poder político, conseguiram estabelecer o tribunato da plebe e os seus poderes, de certa forma, ilimitados. Diversas são as teorias sobre a origem da plebe e diversas são as interpretações acerca das condicioes sociais, políticas e econômicas da plebe no início da república romana. Por um lado, teoriza-se que os plebeus seriam paupérrimos e estavam desgostosos com o tratamento que lhes era concedido. Por outro lado, há correntes que advogam a existência de uma plebe abastada e sedenta por poder. A plebe, utilizando de métodos revolucionários como a resistência e a secessão, conseguiu criar uma magistratura com poderes ilimitados que intercedia e interferia no funcionamento das instituições políticas de Roma. Os tribunos muito podiam, ainda que destituídos de uma competência política geral e dirigente. Questiona-se, portanto, como a plebe sem o domínio do direito e da política conseguiu impor a sua magistratura com a plenitude de seus poderes no concerto constitucional republicano. Tratado entre as ordens, juramento de vingança, consagração aos deuses ou plebiscitos: várias são as teorias acerca da fundamentação do poder tribunício. Pretendeu-se, enfim, no que se refere à fundamentação do poder tribunício, propor uma nova sistematização da matéria, reconstruindo o diálogo histórico dos principais autores que versaram recentemente sobre o tema e recorrendo, principalmente, às fontes literárias como Lívio, Dionísio de Halicarnasso e Cícero.

The tribunate of the plebeians was contributory in securing the freedom of the plebeians and in maturing the republican institutions in Rome. The tribunes, mainly using the power of intercessio, worked for the plebeians and contributed, directly and indirectly, to the adjustment of Roman legal-constitutional order in order to enable a more effective action of the plebeians. The present work inquiries how the plebeians, without active participation in the political power, managed to establish the tribunate of the plebeians and its, in a way, unlimited powers. There are several theories about the origin of the plebeians and countless interpretations of the social, political and economic conditions of the plebeians at the beginning of the Roman republic. On the one hand, it is theorized that the plebeians would be poor and revolted at the treatment gave to them. On the other hand, there are theories that advocate the existence of a wealthy and power-hungry plebeians. The plebeians, using revolutionary methods such as resistance and secession, managed to create a magistracy with unlimited powers that interceded and directly interfered in the functioning of the political institutions of Rome. The tribunes were powerful without having powers. It is therefore questioned how the plebs without ruling of law and politics managed to impose their magistracy with the fullness of their powers. A treaty among the orders, an oath of revenge, a consecration to the gods or plebiscites: there are several theories about the substance of the tribunician power. It is intended, regarding the substance of the tribunician power, to propose a new systematization of the subject, reconstructing the historical dialogue of the main authors who recently dealt with the subject and resorting mainly to the literary sources such as Livy, Dionysius of Halicarnassus and Cicero.
