A latente desigualdade social, característica marcante da nossa sociedade, impõe ao Estado a necessidade de alterar a ótica na construção das políticas públicas para efetivação dos direitos humanos. Diante desse cenário, a presente tese, partindo de uma revisão bibliográfica da Antropologia, Serviço Social e Sociologia sobre a questão da rua, inicia a descrição do tratamento legal no âmbito internacional e nacional e institucional conferido a população de rua. Essa análise permite constatar como o Direito contribuiu para a construção de estigmas em relação à população de rua e sua criminalização. Por outro lado, a política da assistência social se estrutura com vistas a quebrar esse paradigma discriminatório, mas não é capaz de romper com os resquícios da filantropia no oferecimento desses serviços. A falência dessas políticas públicas implica o aumento da população de rua e como o Estado lida com a questão: ao gerenciar o espaço público violenta, exclui e extermina essas pessoas por meio de serviços de limpeza. Para arrematar a tese, o exemplo de um projeto canadense, ocorrido entre 2000 e 2010, apresenta algumas diretrizes para arranjos intergovernamentais e interinstitucionais para lidar com questões multicausais como as da rua. Por fim, é possível constatar que tanto o exemplo canadense como o brasileiro apontam para a fragilidade das políticas públicas voltadas para a população em situação de rua.

The latent social inequality, a striking feature of our society, imposes on the State the need to change the perspective in the construction of public policies for the realization of human rights. Given this scenario, the present thesis, starting from a bibliographical review of Anthropology, Social Service and Sociology on the question of the street, begins the description of the legal treatment - at the international and national - and institutional level conferred on the street population. This analysis shows how the Law contributed to the construction of stigmas in relation to the homeless people and its criminalization. On the other hand, social assistance policy is structured with a view to breaking this discriminatory paradigm, but it is not capable of breaking with the remnants of philanthropy in offering these services. The bankruptcy of these public policies implies the increase of the homeless people and how the State deals with the issue: in managing violent public space, it excludes and exterminates these people through cleaning services. To conclude the thesis, the example of a Canadian project, which occurred between 2000 and 2010, presents some guidelines for intergovernmental and interinstitutional arrangements to deal with multicausal issues such as those on the street. Finally, it is possible to observe that both the Canadian and the Brazilian example point to the fragility of the public policies directed at the homeless people.
