O presente trabalho parte da ideia de que a difusão do Direito Internacional dos Refugiados constitui aspecto de suma importância para os objetivos de proteção, implementação e efetivação dos direitos dos refugiados e que a inclusão desta pauta no âmbito do ensino superior, bem como a possibilidade de acesso dos refugiados a este nível educacional, são dois fatores que podem contribuir, significativamente, para a consecução desses objetivos. Verifica-se, contudo, que embora seja possível constatar a existência de um direito de acesso ao ensino superior em condições de igualdade em relação aos brasileiros, este direito acaba sendo obstaculizado na prática, fazendo com que a igualdade se restrinja ao âmbito meramente formal. A partir desta constatação, analisa-se a necessidade de implementar mecanismos específicos que possibilitem a existência de um patamar de igualdade substancial entre refugiados e nacionais no que se refere ao acesso ao ensino superior. Para tanto, é realizada uma pesquisa empírica que traça um panorama das ações e políticas públicas existentes (ou inexistentes) à nível nacional, no âmbito do Governo Federal, dos Governos do Estado de São Paulo, do Rio de Janeiro e do Paraná, das Universidades desses três Estados e da UNESCO. Por fim, são analisadas outras ações e políticas implementadas voltadas à promoção do acesso ao ensino superior por refugiados e grupos em situação de vulnerabilidade - Cátedra Sérgio Vieira de Mello do Alto Comissariado das Nações Unidas para os Refugiados (CSVM do ACNUR), Programa Pró- Haiti, Programa DAFI (Albert Einstein German Academic Refugee Initiative) e políticas de ações afirmativas- , com o intuito de fornecer substrato para reflexão e elaboração de novas ações ou aprimoramento das já existentes, visando aumentar o acesso de refugiados ao ensino superior.

The present dissertation is based on the idea that the diffusion of International Refugee Law is an aspect of importance for the objectives of protection, implementation and enforcement of refugee rights and that the inclusion of this agenda in higher education institutions, as well as the possibility of refugee access to this educational level, are two factors that can significantly contribute to the achievement of these objectives. However, although it is possible to verify the existence of a right to access higher education on an equal basis with brazilians, this right faces obstacles in practice, making equality limited to a formal scope. Based on this observation, it is analyzed the need to implement specific mechanisms that allow the existence of a substantial level of equality between refugees and nationals regarding the access to higher education. For this, an empirical research is carried to outline an overview of existing (or non-existenting) actions and public policies at the national level, in the scope of the Federal Government, the Governments of the State of São Paulo, Rio de Janeiro and Paraná, the Universities of these three States and UNESCO. Finally, other actions and policies implemented to promote access to higher education by refugees and vulnerable groups are analyzed - SergioVieira de Mello Chair of UNHCR, Pro-Haiti Programme, DAFI Programme (Albert Einstein German Academic Refugee Initiative) and affirmative action policies-, with the purpose of providing substrate for reflection and elaboration of new actions or improvement of existing ones, in order to increase the access of refugees to higher education.
