O presente trabalho é um estudo sobre a legislação e a prática brasileiras em matéria de reconhecimento da condição de refugiado a partir da Lei Federal específica sobre o Estatuto dos Refugiados (a Lei n. 9.474/97), com ênfase na aplicação da definição ampliada de refugiado estabelecida na Declaração de Cartagena (1984) e a forma que a mesma assume ao ser incorporada à Lei Brasileira de Refúgio, através do conceito de "grave e generalizada violação de direitos humanos". Para tal, a pesquisa realiza um apanhado histórico relativo à evolução do conceito de refúgio, o qual nos auxilia a remontar os caminhos pelos quais o quadro de proteção às pessoas em situação de refúgio ganha corpo no panorama brasileiro. Assim, através de reflexões sobre os direitos dos refugiado(as) no Brasil, o estudo analisa os possíveis significados atribuídos à definição ampliada de refugiado no país.

The present study is an investigation on the legislation and Brazilian legal practice related to the refugee status determination procedures, based on the Brazilian Refugee Act (Federal Law No. 9474/97). The research is conducted with emphasis on the application of the extended refugee definition established by the Cartagena Declaration (1984) and its incorporation on the Brazilian Refugee Act through the concept of "gross and massive violation of human rights". For this purpose, a historical survey draws on the evolution of the refugee definition, by which the protection framework for people in a refugee-like situation can be drawn in the Brazilian context. In this sense, based on analysis on the rights of refugees in Brazil, this study presents its reflections on the possible meanings attributed to the extended refugee definition.
