O objetivo da presente dissertação de mestrado foi investigar de que maneira as mulheres negras são protegidas, ou não, pelo Direito de Família brasileiro, considerando-se as suas especificidades enquanto grupo racial e de gênero historicamente oprimido, além da formação jus positiva brasileira com base no direito (e, portanto, em suas estruturas sociais) europeuocidental. Para tanto, realizei um levantamento bibliográfico e uma pesquisa empírica desenvolvida por meio de um formulário online utilizando a técnica de bola de neve para o seu compartilhamento, de modo a averiguar como se constituem as relações afetivas da mulher negra atualmente,quais as suas demandas familiares atuais e a qualidade do seu acesso à Justiça. Concluo que há especificidades em relação às mulheres negras no que tange aos planos de contrair matrimônio, viver em união estável, ter filhos(as) e o significado de família. Além disso, não foram apontados grandes entraves ao acesso à Justiça, em geral, mas reporto ser necessário aprofundamento neste ponto para entender as variáveis que ficaram em aberto sobre os temas que originaram as ações judiciais e o que se espera dos processos.

The purpose of this dissertation was to investigate how black women are protected or not by Brazilian Family Law, considering their specificities as a historically oppressed racial and gender group, besides the Brazilian positive law based on European-Western Law (and therefore its social structures). To do so, I carried out a bibliographical survey and empirical research developed through an online form using the snowball technique for its sharing, in order to find out how the affective relations of black women are constituted today, what their current family demands are and the quality of the access to Justice. I conclude that there are specificities regarding black women in relation to plans to marry, live in a stable union, have children and the meaning of family. In addition, there were no major barriers to access Justice in general, but there is a need to deepen this point to understand the variables that remained open on the issues that originated the lawsuits and what is expected from them.
