Esta tese discute os arranjos político-jurídicos, em torno do tema da laicidade do Estado brasileiro, que foram utilizados para lidar com as demandas das religiões de matriz africana e afro-brasileiras. Procura responder à seguinte pergunta: no que consiste o arranjo da laicidade brasileira, considerando-se como ela afeta as religiões minoritárias no Brasil, mais especificamente as de matriz africana e afro-brasileira? Para responder a essa questão, recorremos a um conjunto de técnicas de pesquisa que permitiu conhecer e compreender os sentidos dados à laicidade no mundo acadêmico, jurídico e, também, no campo das religiões de matriz africana e afro-brasileiras. As técnicas utilizadas foram a pesquisa bibliográfica, a análise da jurisprudência e a pesquisa de campo, por meio de entrevistas semiestruturadas. A pesquisa bibliográfica implicou a seleção e a discussão de autores do campo do ordenamento sociojurídico, dedicados aos estudos das complexidades presentes nos embates entre laicidade e secularização, no que diz respeito ao uso do espaço público. Nesse sentido, contamos com a contribuição de autores como Max Weber (2004), Peter Berger (2013), José Casanova (2007; 2009), Flávio Pierucci (1998) e Ricardo Mariano (2001), entre outros que compuseram os marcos teóricas da tese. A análise jurisprudencial envolveu os principais julgados do Supremo Tribunal Federal, buscando-se compreender como a laicidade e a religião foram abordadas nas decisões do Poder Judiciário. São eles: o Mandado de Segurança nº 1.114 (Caso da Igreja Católica Apostólica do Brasil), no RE nº 562.351 (imunidade tributária da Loja Maçônica/RS), a ADI nº 4.439 (ensino religioso), a ADI nº 4277 e a ADPF nª 132 (união estável homoafetiva), RE nº 494.601 (abate religioso), a ADI nº 3.510 e a ADPF nº 54 (direito à vida). Além da jurisprudência da Corte, também analisamos os Pedidos de Providências (1.344, 1.345, 1.346 e 1.362) do Conselho Nacional de Justiça (CNJ), sobre a presença de símbolos religiosos nos espaços públicos. A pesquisa de campo trouxe para análise e discussão a perspectiva de membros da religião de matriz africana sobre os sentidos que ofereceram para a laicidade e para o modo como suas demandas foram compreendidas pelo Estado brasileiro. Para isso, foram realizadas entrevistas em Terreiros salvaguardados com o instituto do tombamento. As entrevistas foram analisadas por meio do método de análise de conteúdo, proposto por Laurence Bardin (2011) e Maria Cecília Minayo (2001). O corpus da pesquisa foi discutido à luz dos marcos teóricos assumidos na investigação. Observamos que a laicidade do Estado brasileiro é fundamental para a garantia da liberdade religiosa. Contudo, não foi possível afirmar que o Estado brasileiro já tenha alcançado um sentido definitivo para laicidade ou tenha consolidado instrumentos que garantam os direitos de todos os credos, sem distinção. Esse quadro denota uma fragilidade da lacidade brasileira, que coloca em risco a salvaguarda da liberdade religiosa das religiões de matriz africana e afro-brasileiras.

This thesis discusses the political-juridical arrangements, around the theme of the laity of the Brazilian State, that were used to deal with the demands from the African and AfroBrazilian religions matrix. The thesis tries to answer the following question: what is the arrangement of Brazilian laity considering how this affects the minority religions in Brazil, more specifically those of African and Afro-Brazilian matrix? To answer this question, a set of research techniques was used to know and understand the meanings given to secularity in the academic, juridical world and also in the field of African and AfroBrazilian religions. The techniques used were: bibliographic research, case law analysis and field research through semi-structured interviews. The bibliographical research involved the selection and discussion of authors from the socio-juridical field planning dedicated to the study of the complexities present in the conflicts between laity and secularization with regard to the use of public space. In this sense, we studied authors like Max Weber (2004), Peter Berger (2013), José Casanova (2007;2009), Flávio Pierucci (1998) and Ricardo Mariano (2001), among others who composed the thesis theoretical frameworks. The jurisprudential analysis involved the main judges of the Federal Supreme Court, seeking to understand how secularity and religion were approached in the decisions of the judiciary, being: Mandate of Security nº 1.114 (Case of the Apostolic Catholic Church of Brazil), RE n. 562,351 (Tributary immunity of Masonic Lodge / RS), ADI n. 4,439 (religious education), ADI n. 4277 and ADPF n. 132 (Stable homoaffective union), RE no. 494.601 (Religious slaughter), ADI n. 3,510 and ADPF n. 54 (Right to life). In addition, from the jurisprudence of the Court, it also analyzed the Requests for Provisions (1,344, 1,345, 1,346 and 1,362) of the National Justice Council (CNJ) on the presence of religious symbols in public spaces. Field research brought to the discussion the perspective of members from the African-based religion on the meanings they offered for secularity and the way in which their demands were understood by the Brazilian State. For this purpose, interviews were conducted in Terreiros? assured with the listed heritage institution. The interviews were analyzed using the content analysis method proposed by Laurence Bardin (2011) and Maria Cecília Minayo(2001). The corpus of the research was discussed in the light of the theoretical frameworks assumed in the research. We observe that the secularism of the Brazilian State is fundamental to the guarantee of religious freedom. However, it was not possible to affirm that the Brazilian State has already reached a definitive meaning for what would be secularity or has consolidated instruments that guarantee the rights of all creeds, without distinction, which shows a fragility in the implementation of this principle. We conclude that this fragility of Brazilian laity jeopardizes the safeguarding of the religious freedom of African and Afro-Brazilian religions.
