Esta tese tem o objetivo de compreender as tendências contemporâneas na teoria jurídica e examiná-las criticamente à luz da contribuição pachukaniana sobre o direito como forma social. Para tanto, recorre-se a abordagens teóricas sobre o contemporâneo alinhavadas pela questão do primado da linguagem na teoria, que pode ser entendido, de modo geral, como uma ênfase na linguagem como lugar de conhecimento do real. Como um expediente heurístico, aborda-se o tema da transformação do discurso teórico na pós-modernidade, sobretudo a partir de Fredric Jameson, chegando à chamada virada linguística na filosofia como momento primevo da tendência da crise da representação que será levada à plena realização na pós-modernidade. Explora-se a virada linguística no âmbito da filosofia analítica, ambiente intelectual da teoria do direito que serve de contraponto ao final desta tese. Adicionalmente, procura-se alcançar uma compreensão materialista do fenômeno do primado da linguagem como ensejado pelas reconfigurações do capitalismo após a década de 1970. Na segunda parte deste trabalho, avança-se uma hipótese sobre a reconfiguração da teoria juridica contemporânea em confluência com a conformação da ideologia jurídica às condições pós-fordistas. Após uma reconstrução da crítica de Evgeni Pachukanis à teoria geral do direito e ao positivismo jurídico de Hans Kelsen, com apoio no aparato teórico desenvolvido ao longo do trabalho, realiza-se uma incursão crítica nos principais conceitos da teoria de Ronald Dworkin, considerada como uma das mais relevantes teorias jurídicas da contemporaneidade e situada como uma oposição ao positivismo jurídico.

This thesis aims to grasp the contemporary tendencies in legal theory and analyze them in the light of Pashukanis remarks about law as a social form. In order to do so, we resort to theoretical approaches about the contemporary predicament rooted in the question of the primacy of language in theory, which can be understood, in a broad sense, in terms of language as a privileged locus of production of knowledge about reality. As a heuristic expedient, we approach the theme of the transformation of theoretical discourse in post-modernity, especially after Fredric Jameson, arriving at the so-called linguistic turn in philosophy as the first moment of the tendency of the crisis of representation that will be brought to full realization in post-modernity. The linguistic turn is explored within analytic philosophy, the intellectual background of the legal theory that serves as a counterpoint at the final part of this dissertation. Moreover, we seek to achieve a materialist understanding of the phenomenon of the primacy of language as brought about by the reconfigurations of capitalism after the 1970s. In the second part, we put forward a hypothesis on the reconfiguration of contemporary legal theory in confluence with the conformation of legal ideology to post-Fordist conditions. After a reconstruction of Evgueny Pashukanis critique of the general theory of law and of Hans Kelsen's legal positivism, underpinned by the theoretical apparatus developed throughout this thesis, a critical incursion is made into the main concepts of Ronald Dworkins theory, considered as one of the most relevant contemporary legal theories and regarded as an opposition to legal positivism.
