O termo afro-brasileiro tem sido empregado em documentos jurídicos. Seu sentido tem sido disputado como obstáculo a adoção de políticas públicas em prol da população negra no Brasil (pretos e pardos somados), com intensidade a partir da implementação das ações afirmativas. A população negra (pretos e pardos somados) é estimada em 50,7% dos cerca de 191 milhões de habitantes do Brasil no Censo de 2010 (IBGE, 2010). Apresenta histórico de piores indicadores socioeconômicos na comparação com a população branca em cada um dos indicadores já pesquisados. Nesse contexto, o objetivo é apurar se o vocábulo afro-brasileiro possui significado jurídico para o direito constitucional brasileiro à luz da Constituição Federal de 1988. Por meio de pesquisa documental e bibliográfica visa responder as seguintes indagações: A palavra afro- brasileiro é mencionada expressa e/ou implicitamente na Constituição Federal de 1988? Seu sentido seria estritamente biológico-genético ou seria conceito sociopolítico-cultural atrelado a considerações sobre fenótipo e lugar social? Seu significado designaria indivíduos e/ou grupos populacionais? Nomearia titular ou titulares de direitos subjetivos com assento constitucional? A pesquisa, portanto, pretende contribuir para a interpretação constitucional.

The term Afro-Brazilian has been adopted for use in legal documents. Its meaning has been disputed as an obstacle to the adoption of public policies to the black population in Brazil (blacks and pardo), with intensity from the implementation of affirmative actions. The Brazil 2010 population is estimated at 191 million people. The black population (blacks and pardo) is equivalent to 50,7% of the total Brazil population (IBGE, 2010). The black population in Brazil has historically tend to have worse socioeconomic status than the white population. In this context, this research aims to determine whether the term Afro-Brazilian has a legal meaning for constitutional law in the light of the Constitution of 1988. Through documentary and bibliography research, it aims to answer the following questions: Is the term Afro-Brazilian mentioned expression and/or implicitly in The Federal Constitution of 1988? Would its meaning be strictly biological-genetic, or would it be a sociopolitical-cultural concept linked to considerations about phenotype and social classification? Would its meaning designate individuals and/or populations? Would it designate the holder or holders of subjective rights with a constitutional seat? The research aims to contribute to constitutional interpretation.
