A presente dissertação insere-se no âmbito do Programa de Mestrado da PósGraduação Stricto Sensu da Faculdade de Direito da USP (FDUSP) na área de concentração de Direitos Humanos. Trata-se de pesquisa sobre a proteção trabalhista para solicitantes de refúgio e refugiados no Brasil com foco na cidade de São Paulo. A presente investigação debruça-se sobre a temática da proteção trabalhista, especialmente a partir do direito de acesso ao emprego formal, à luz de lentes empíricas, tendo como espaço geográfico delimitador a cidade de São Paulo. A partir da ideia de a integração local ser tida como uma solução viável para refugiados que vivem em cidades, tem-se como objetivo identificar especificidades do acesso ao emprego formal tanto para solicitantes de refúgio e refugiados que estão inseridos no contexto urbano. Assim, a pesquisa parte de um panorama global e nacional da interação do direito dos refugiados e do direito do trabalho sob os auspícios da indivisibilidade e efetividade dos direitos humanos. Em seguida, faz uma abordagem metodológica enfatizando a importância em se reconhecer sujeitos de direito, destacando a sua narrativa pessoal, seja pela sua definição jurídica objetiva, seja pela sua subjetividade, ou mesmo pela interseccionalidade e vulnerabilidades a que estão submetidos, justificando assim o recorte temático necessário quanto aos sujeitos pesquisados. A partir dessa abordagem, expõe breve mapeamento da rede de proteção de direitos disponível para solicitantes de refúgio e refugiados na cidade de São Paulo. Ao final, apresenta a coleta e análise de evidências empíricas obtidas por meio de uma metodologia exploratória-indutiva que tem como objetivo observar a efetividade desses direitos e contornar a temática estudada tendo em vista a maneira pela qual solicitantes de refúgio e refugiados vivenciam na prática o direito ao acesso ao emprego formal.

This dissertation is part of the Stricto Sensu Master's Program of the Faculty of Law of the University of São Paulo (FDUSP) in the Human Rights concentration area. It is a research on labour protection for asylum seekers and refugees in Brazil focused on the city of São Paulo. The present investigation addresses on the topic of labour protection, especially focused on the access to formal employment right, based on empirical lenses, with the geographical space of the city of São Paulo as a boundary. Grounded on the idea that local integration is considered as a viable solution for refugees living in cities, the research aim is to articulate specific aspects of access to formal employment for both asylum seekers and refugees who are inserted in an urban context. Hence, the research sets off from a global and national panorama of the interaction of refugees' rights and labour rights under the auspices of the indivisibility and effectiveness aspect of human rights. Subsequently, it makes a methodological approach emphasizing the importance of recognizing subjects of law, highlighting their personal narrative, either by their objective legal definition, or by their subjectivity, or even by the intersectionality and vulnerabilities to which they are submitted, thus justifying the necessary thematic delimitation regarding the studied subjects. Throughout this approach, it exposes a brief mapping of the protection of rights' network available to asylum seekers and refugees in the city of São Paulo. Finally, it presents the data collection and analysis of empirical evidences obtained via an exploratory-inductive methodology whose objective is to observe the effectiveness of these rights and to outline the studied thematic bearing in mind the way in which asylum seekers and refugees experience the right to access to formal employment.
