A partir da aplicação do método materialista histórico-dialético estuda-se a determinação específica representada da cidade e do direito no modo de produção capitalista. Essa tese apresenta uma crítica marxista ao direito à cidade a partir do diálogo das teorias de Henri Lefebvre e Evegeni Pachukanis. Para tanto, estrutuou-se uma introdução contendo a exposição do referencial teórico-metodológico e a exposição da problemática a ser analisada. No Capítulo 1, apresenta-se como a cidade foi abordada por Karl Marx e Fridrich Engels e, posteriormente, a teoria de Henri Lefebvre, especialmente sobre o espaço urbano. Como recorte de temáticas abordou-se a relação entre a urbanização e industrialização, a produção do espaço e a centralidade da vida cotidiana, a concepção de Estado, a crítica ao urbanismo e o conceito de direito à cidade. Por meio dessa análise, almeja-se evidenciar a produção capitalista da cidade e o qual o papel que ela cumpre para a acumulação capitalista no século XXI. No capítulo 2, expõe-se a teoria de Evgeni Pachukanis, observando a relação entre o direito e o modo de produção capitalista. O enfoque será desvendar a forma jurídica, o sujeito de direito, o Estado e a ideologia jurídica. Com suporte nas construção teoóricas que serão realizadas nos estágios precedentes, no terceiro e ultimo capítulo, observa-se como a teoria dos dois autores principais estudados podem dialogar, para então se chegar a crítica ao direito á cidade. Em primeiro plano, confrontou-se a teoria de Henri Lefebvre com a forma jurídica. Em segundou, buscou-se afirmar qual a dimensão jurídica da cidade, para então compreender o que seria o direito à cidade a partir da crítica marxista. Por todo o exposto, espera-se alcançar a superação da sociedade urbana e da forma jurídica como possível resposta às querelas e segregação sofrida pela classe trabalhadora nas grandes cidades.

By the apliccation of the dialectical historical materialsitic method, the presente thesis studies the specific determination of the city and the law represented in the capitalist production mode. Here is presented a marxist criticize of the right to the city trought a dialogue between Henri Lefebvre and Evegeni Pachukanis. To do so, was structured a introduction with a exposition of thetheoretical-methodological and the exposition of the problematics to be analyzed. In the first chapter, is presented how the city was aprouched by Karl Marx and Fridich Engels, and posteriorly, the Henri Lefebrve theory, specially about the urban space. By the clipping of thematics, the chapter approached the relation between the urbanization and the industrialization, the space production and the centrality of the daily life, the concept of State,and finally the criticize of the urbanismo and the right to the city. Trought this analyzes, scopes to evidence the capitalist production of the city, and what is the roll that she accomplishes to the capitalist accumulation in the XXI century. In the 2nd chapter, is exposed the Evgeni Pachukanis theory, by observing the relation between the law and the capitalista production mode. The focus is to unravel the legal form, the subject of Law, the State and the Law ideology. With the suport of theoreticals constructions that will be accomplished in the following chapters, third and last chapter, observes how the theory of both author cited in this thesis, can dialogue between themselves to accomplish a criticize to the right to the city. First, is presented the confrontation between Henri Lefebrve theory with the legal form. Second, sought to afirm what is the legal dimension of the city, so aftwerwards, comprehend what it would be the right to city by the marxist lens. Trought this analyzes, hopes to overcome the urban Society and the legal form as a possible answer to the quarrels and segregation suffered by the diferent working classes of the big citys.
